from the eastern property line of Map 61, Plot 3 to the northern side line of State Route 28, thence easterly along the northern side line of State Route 28, said easement to be sold or assigned only con- junction with, and upon approval of the Planning Board of, a Special Permit for an Open Space Incentive Development under Section 9.3 of the Zoning By-Law on those lands shown on the 1985 Mashpee Assessors ' Maps as Map 54, Plots 1 and 2, and furthermore, that the Board of Selectmen be authorized to alter or realign the location of said easement in. the event the Massachusetts Department of Public Works requires the movement of said easement in a westerly direction, provided that said alteration or realignment does not have significant adverse impact on the intended uses of that Town-owned land, Motion to indefinitely postpone . . . . . . . . . . . . . . . . . . . . . . . . 9:31 P.M. This article would grant an easement across a parcel of Town land (now partially occupied by the landfill) to Dolphin Bay Corporation to allow develop- ment of an OSID project without construction of an access road across sensitive wetlands in the Quaker Run drainage area. The proposed project lies "behind" the Sea Oaks Condominiums north of Route 28. The locus of this easement is shown on the plan previously re- ferenced. Article 56 : To see if the Town will vote to authorize the Board of Selectmen to acquire by purchase or by eminent domain for conservation purposes a parcel of land shown on the 1985 Mashpee Assessors ' Maps as Map 16, Plot 41 generally located between Cotuit Road, Tobey's Back Road and the north side of Santuit Pond, the said land to be held in the care and custody of the Conservation Commission, pursuant to General Laws Chapter 40 , Section 8C; further, to see if the Town will vote to appropriate a $610 000 for such purpose, including expenses incidental and re aced thereto, and to raise such appropriation, the Treasurer , with the approval of the Selectmen, be authorized to borrow $6509000. under and pursuant to Chapter 44, Section 7 (3) , and'if app- licable, Chap40 Section 8C, of the General Laws, or any other enabling authority, and to issue bonds or notes of the Town therefor with said bonding authorization contingent upon passage of a referendum to exclude the principal and interest on such debt from the tax levy limitation imposed by Chapter 59, Section 21C of the General Laws (so-called Proposition 2 1/2) ; and further, to see if the Town will vote to raise and appropriate $32, 500. to the Interest on Temporary Loans Account and to- tne* Issuance of Debt Account; further , to see if the T1CW0Vill authorize the Board of Selectmen and/or Conservation Commission to apply for and accept Federal and/or State grants, including reim- -50-
