from the eastern property line of Map 61, Plot 3 to the northern side <br /> line of State Route 28, thence easterly along the northern side line <br /> of State Route 28, said easement to be sold or assigned only con- <br /> junction with, and upon approval of the Planning Board of, a Special <br /> Permit for an Open Space Incentive Development under Section 9.3 of <br /> the Zoning By-Law on those lands shown on the 1985 Mashpee Assessors ' <br /> Maps as Map 54, Plots 1 and 2, and furthermore, that the Board of <br /> Selectmen be authorized to alter or realign the location of said <br /> easement in. the event the Massachusetts Department of Public Works <br /> requires the movement of said easement in a westerly direction, <br /> provided that said alteration or realignment does not have significant <br /> adverse impact on the intended uses of that Town-owned land, <br /> Motion to indefinitely postpone . . . . . . . . . . . . . . . . . . . . . . . . 9:31 P.M. <br /> This article would grant an easement across a <br /> parcel of Town land (now partially occupied by the <br /> landfill) to Dolphin Bay Corporation to allow develop- <br /> ment of an OSID project without construction of an <br /> access road across sensitive wetlands in the Quaker <br /> Run drainage area. The proposed project lies "behind" <br /> the Sea Oaks Condominiums north of Route 28. The locus <br /> of this easement is shown on the plan previously re- <br /> ferenced. <br /> Article 56 : <br /> To see if the Town will vote to authorize the Board of Selectmen to <br /> acquire by purchase or by eminent domain for conservation purposes a <br /> parcel of land shown on the 1985 Mashpee Assessors ' Maps as Map 16, <br /> Plot 41 generally located between Cotuit Road, Tobey's Back Road and <br /> the north side of Santuit Pond, the said land to be held in the care <br /> and custody of the Conservation Commission, pursuant to General Laws <br /> Chapter 40 , Section 8C; further, to see if the Town will vote to <br /> appropriate a $610 000 for such purpose, including expenses <br /> incidental and re aced thereto, and to raise such appropriation, the <br /> Treasurer , with the approval of the Selectmen, be authorized to borrow <br /> $6509000. under and pursuant to Chapter 44, Section 7 (3) , and'if app- <br /> licable, Chap40 Section 8C, of the General Laws, or any other enabling <br /> authority, and to issue bonds or notes of the Town therefor with said <br /> bonding authorization contingent upon passage of a referendum to <br /> exclude the principal and interest on such debt from the tax levy <br /> limitation imposed by Chapter 59, Section 21C of the General Laws <br /> (so-called Proposition 2 1/2) ; and further, to see if the Town will <br /> vote to raise and appropriate $32, 500. <br /> to the Interest on Temporary Loans Account and <br /> to- tne* Issuance of Debt Account; further , to see if the T1CW0Vill <br /> authorize the Board of Selectmen and/or Conservation Commission to <br /> apply for and accept Federal and/or State grants, including reim- <br /> -50- <br />
