MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 26, 2025 <br /> The easterly side yard dimension is improving from 12.3 ft. to 13.4 ft., and the rear <br /> yard setback is improving from 8.6 ft. to 14.2 ft. All these setbacks are improving <br /> the lot. <br /> There will also be several improvements of the proposed structure itself. The new <br /> house will be flood zone compliant; it will be building code compliant. There will be <br /> an IA septic system installed, and this project was approved by the Conservation <br /> Commission. There is a storm water management system for this lot that was <br /> nonexistent. <br /> Mr. Reidy read the Board of Health comments into the record; "BOH.Property is deed <br /> restricted to 2 bedroom. Plans show 2 bedroom, septic upgrade to IA 2 bedroom system <br /> with sampling requirements of meeting 19 mg/L nitrogen per local regulation." <br /> Mr. Reidy read the Conservation Department comments into the record. "The <br /> conservation commission issued an order of conditions (OOC) approving this raze and <br /> replace at their 3/6/25 public meeting. The project meets performance standards for <br /> Land Subject to Coastal Storm Flowage under Mashpee's Chapter 172 Wetland <br /> Bylaw. OOC was issued on 3/19/25." <br /> The Board read several abutter letters into the record that were in favor of the <br /> project. There was one abutter that resides at 19 Wilsons Grove that had concerns <br /> regarding light and air, which is not a zoning issue. <br /> Chairman Bonvie had a concern regarding the recharge basin that may overflow <br /> because it is only a foot above the ground water. Mr. Foley is looking at adding an <br /> extra recharge station. They are decreasing the impervious material, and adding a <br /> new recharge system connecting the gutters. Mr. Bonvie likes the revised plan <br /> because there is a reduction in the lot coverage. <br /> Mr. Bonvie had concerns with a vent that is located next to the front stairs. Mr. Foley <br /> said he is looking at the new system, and that has a charcoal filter to help with that <br /> situation. <br /> Mr. Furbush is glad that the proposed size of the house was reduced. He wanted to <br /> confirm that there are dry wells being installed. Mr. Foley said; yes. <br /> Mr. Morris agrees with the Chair that it is a vast improvement. The lot coverage was <br /> reduced. He will address the height issue, and he will require an elevation certificate <br /> on the building from the original grade for the frame inspection during the permitting <br /> process. <br /> 4 <br />
