He will pull this item from the Agenda until an update is provided. <br /> NEW BUSINESS <br /> Noisy Hole Road Covenant Request for Release <br /> Mr. Tobin stated 208 Noisy Hole Rd. shows as Lot 54. A settlement agent would like to <br /> address a clerical error dating back to the late 80's. There was a covenant on the entire <br /> subdivision known as the Park Place subdivision. Initially, this Board voted to release a <br /> number of lots on Noisy Hole Rd., and then several lots on other streets. The release of other <br /> streets got recorded first, Noisy Hole got recorded and referenced the other release instead of <br /> the restriction. There was no reference to the first covenant and now the applicant seeks <br /> correcting for release of Lot 54. <br /> On 03/86 this Board voted to release. On 07/24/86 that release was recorded, including this <br /> lot. On 10/10/86 there was a building permit issued. On 04/27/87 there was a certificate of <br /> occupancy issued. Noisy Hole Road is presently town-owned. There is a town water card <br /> showing it is getting access to town water. Mr. Tobin did not receive verifications for electric or <br /> gas, however counsel representing the applicant verified they are tied in as well. <br /> The owner closed on the property last Friday, subject to release of covenant. <br /> MOTION: <br /> Mr. Balzarini made a motion to approve the release of the covenant for 208 Noisy <br /> Hole Road. Seconded by Mr. Richardson.All in favor. <br /> CHAIRS REPORT <br /> Ms. Waygan reviewed the Agenda with Mr. Tobin. <br /> She emailed Town Manager Collins regarding the acquisition of 475 Nathan Ellis Highway. <br /> The CPC fought really hard to get the Town to purchase that land. The CPC has administrative <br /> money, and a vote was taken to offer a pot of money to the Town Manager and Select Board's <br /> office to aid staff in finding out how to clean up that area, provide public access, and restore <br /> the dry river. <br /> Ms. Faulkner noted the old Zachary's establishment is for sale. <br /> TOWN PLANNER REPORT <br /> Publication of Public Notices <br /> The Public Notices went out for the Public Hearing on April 30t" regarding our proposed ADU <br /> Bylaw Article 24, that is bringing the ADU provision in line with the Affordable Homes Act that <br /> regulates ADU's. <br /> 5 <br />
