MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 23, 2025 <br /> Mr. Goldstein, second, yes <br /> Mr. Furbush, yes, <br /> Mr. Ganzenmuller, yes, <br /> Mr. Caggiano, yes. <br /> Ms. Sangeleer, yes. <br /> All were in favor to issue a Special Permit. <br /> 420 Nathan Ellis Hwy: Petitioner, NextGrid Persimmon LLC requests an Appeal of <br /> the Building Commissioner's Decision under M.G.L. Chapter 40A §§8 and 15. <br /> Petitioner disputes the Building Commissioner's determination that medium and <br /> large scale ground mounted solar energy systems in the C-2 Zoning District requires <br /> a Special Permit from the Planning Board subject to §174-45.7 of the Zoning Bylaws, <br /> and not allowed in an R-5 Zoning District, Map 72, Parcel 118, Mashpee, MA. (Owner <br /> of Record: OBRM LLC, Trustee of the Brickyard Road Realty Trust). <br /> Sitting on this hearing are Ms. Sangeleer, Mr. Furbush, Mr. Goldstein, Mr. Milbury <br /> and Mr. Reidy. <br /> Mr. Milbury asked if the Board can hear this petition after reading the Conservation <br /> Agent comment that it requires an application with the Commission. <br /> The Board commented; yes, that it does require a hearing with Concom. <br /> Ms. Sangeleer read the comment submitted by Mr. Morris back in July 2024 that is <br /> noted in the withdrawal decision regarding ground mounted solar projects. Stated: <br /> (Mr. Morris stated that this proposal was (emphasis added) submitted as large scale <br /> ground mounted solar. Small scale ground mounted solar is allowed in an R-5 <br /> residential. It is not allowed on a large scale as was proposed, and should be submitted <br /> separately from the C-2 Zoning District. The C-2 is allowed on a larger scale through <br /> the Planning Board (emphasis added) who is the Special Permit granting authority. A <br /> proposal would be required to be submitted to the Planning Board for the C-2. Mr. Morris <br /> stated that this would be a good use for this area. Mr. Morris stated he would like to <br /> see a small scale solar in the residential area, not a large scale solar. The large scale <br /> solar would be denied. Two separate proposals would be required because there are <br /> two separate zoning districts.)" <br /> Mr. Reidy read the Town Planner comments into the record dated April 23, 2025; <br /> "The application is not complete.
