MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 23, 2025 <br /> Mr. Caggiano second, yes, <br /> Mr. Furbush, yes, <br /> Mr. Goldstein, yes, <br /> Mr. Milbury, yes, <br /> Ms. Sangeleer, yes. <br /> All were in favor to issue a Written Finding. <br /> 25 Wilsons Grove: Owners, Serry J. Gouveia Revocable Trust, and Manuela G. <br /> Gouveia, Revocable Trust request a Special Permit under §174-17.1 and §174-33 of <br /> the Zoning Bylaws to raze and replace an existing single family residential structure <br /> with a new single family structure on property located in the Popponesset Overly <br /> District and R-3 District, Map 118, Parcel 92, Mashpee, MA. (Continued from <br /> 3112125, and 3126125 hearings at the request of the Attorney). <br /> Attorney Christopher Kirrane presented. Also present was Brian Foley with Clancy <br /> Construction. <br /> The lot is entirely within Land Subject To Coastal Storm Flowage. The lot is located <br /> in the Popponesset Overlay District which requires a minimum lot size of 6,000 sq. <br /> ft., minimum frontage of sixty (60') ft., minimum building setbacks 25 ft. from front <br /> lot line, 15 ft. from sides and rear yard setbacks, and maximum lot coverage is 25%. <br /> There are several dimensional nonconformities associated with this lot. The lot is <br /> entirely in the flood zone and therefore has zero square feet of lot area. The lot itself <br /> is very small and has only 3,375 sq. ft. of total area. The setback from wetlands is <br /> zero, and the lot coverage is 100%. The side yard setback is currently 10.2 ft. where <br /> 15 ft. is required. The front yard setback is nonconforming at 2 ft. where 15 ft. is <br /> required. The southeast side has 6.8 ft. where 15 ft. is required. There is a shed <br /> located in the rear of the lot that is 2.4 ft. from the side yard setback, and 3.3 off the <br /> rear yard setback. The front yard setback is currently 37.5 ft. and is nonconforming. <br /> The hearing was continued because the plans needed revisions specifically to <br /> reposition the proposed new house. The coverage of structures is currently 37.9% <br /> which is 1,280 sq. ft. and is remaining the same; there are no changes as far as lot <br /> coverage. The side yard will be improving at 12.7 ft. where 10.2 ft. is existing. The <br /> front yard setback will be improving slightly from 2 ft. to 2.5 ft. This project was <br /> approved by the Conservation Commission, a new IA septic system is being installed, <br /> and the lot has a storm water management system that includes drywells. <br /> 3 <br />
