Mr. Tobin will reach out to the <br /> Affordable Housing Committee about June 4t" or their meeting on June 3rd <br /> Ockway Highlands Tripartite <br /> Mr. Balzarini looked at the swales, a couple weeks ago there was no grass growth near <br /> Degrass Rd. Now, there is grass in the first swale, it had been seeded, the one behind has no <br /> grass at all, it has been cleaned. With the incoming storm, the dirt pile is sitting right next to the <br /> swales, it is going to rain so hard all the silts will fill. <br /> Jacque Morin purchased this subdivision in 2018. He completed all construction of <br /> infrastructure, and in 2019 a subsequent tripartite was entered with various items to be done in <br /> an agreed upon list. All items have been completed, and Town Planner Tobin noted the Board <br /> previously voted to release, subject to a $2,000 surety for the growing of seed in drainage <br /> swales. Mr. Morin described the various attempts to make the said payment, but to no avail. <br /> Mr. Morin argues the work has been completed, he also noted Mr. Pesce also said the work <br /> was completed. It was then brought to the Board's attention this evening, the unseeded swale <br /> in question was at the direction of DPW Director Laurent. Mr. Morin took several photos today <br /> and provided them via e-mail to Town Planner Tobin, showing they are in good shape. The <br /> areas that required seed are now showing signs of growth. He feels it is appropriate to void the <br /> $2,000 requirement. <br /> Mr. Balzarini noted the original plan noted to have grass planted. <br /> Mr. Tobin explained the first vote took place on 7/17/24 with Mr. Lehrer, and a $2,000 surety <br /> was conditioned on item number two, at the Town Engineer's request for loam and seeding of <br /> swales. The Board then voted and reaffirmed that vote on 11/06/24, when interim Town <br /> Planner Fudala was here. A site visit on 3/26 showed all dirt. Mr. Tobin and Mr. Balzarini went <br /> to the site on 4/18, and there was no vegetation. Both the proponent and Mr. Balzarini <br /> indicated, since the visit on 4/18, there has been improvement in the swale closest to Degrass <br /> Rd. In conversations with the DPW, this is the first he is hearing of this recommendation. <br /> Clarity in this area would be appreciated. To reiterate, the swales require vegetation and <br /> $2,000 was conditioned and never received. <br /> Mr. Pesce recalled that meeting on 6/17/24 with Catherine Laurent, DPW Director, to discuss <br /> drainage issues.
