The Special Permit was approved, and the <br /> conservation restriction was lifted, the developer came back to build and was approved by this <br /> Board. When the developer pulled permits, and in between this time, the Town passed the <br /> Tree Preservation Bylaw. There is discrepancy with the fence and new plantings. <br /> Mr. Tobin and Mr. Balzarini performed a site visit for ideas of best practice. The canopy given <br /> off by the mature trees will cause new plantings to die, and future plantings will have the same <br /> issue. The applicant spoke to the neighbor in the immediate lot behind that property, Carol <br /> Souza, who is okay with the arrangement for 132 Orchard Rd. <br /> When Mr. Tobin got in touch with Ms. Souza, who is present this evening, she had different <br /> conversations where there was some miscommunication. Lot 1 of Willow Circle's trees behind <br /> the fence will not be planted, existing trees are not to be cut. <br /> Mr. Tobin inquired about the dead trees. These need to be taken care of, not necessarily <br /> replaced. <br /> Ms. Waygan commented that the plantings can be modified, if the plan calls for 10 and there <br /> are only 8 viable, they can accept that. For tonight's decision, they will address what is being <br /> discussed behind Lot 1, the replacement of dead trees. They can accept a note on the <br /> modified plan, and when the Building Commissioner goes for the final inspection, he will see <br /> the dead trees and it will come back to this Board. The Landscaping Plan is required and the <br /> ones that aren't viable will be marked. Then there will be a modification to the Special Permit. <br /> There was further discussion over the process of modifications. It was suggested the two <br /> modifications could be made at the same time. Ultimately, it was decided they will be <br /> submitted as they appear before the Board, right now only being one modification. Ms. <br /> Waygan stated a neighbor of Ms. Souza may want to comment and this will allow the trees <br /> some time. Today, we are preventing trees from being cut. No trees to be cut on the <br /> southwesterly side of the fence is the only modification being made. <br /> Mr. Tobin is not in favor of this approach, it would be different if there was a certificate of <br /> occupancy, but he thinks it makes more sense for one modification and one plan, making <br /> everything better for future property owners. <br /> This will remain on the agenda for next meeting for a minor special permit modification. This <br /> will give Mr. Eddy some time to follow up with the developer. <br /> 4 <br />
