MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 9, 2025 <br /> 389 Monomoscoy Road <br /> Sitting on this hearing are the four regular Board members and Mr. <br /> Ganzenmuller. <br /> Attorney Christopher Kirrane represented the applicant's request for a Special <br /> Permit in an R-3 Zoning District. Also present was Brad Bertolo with JC <br /> Engineering. <br /> This lot is totally within the flood zone and has three nonconforming situations; <br /> the lot area is in a flood zone and contains zero square feet, setback to wetlands <br /> at zero square feet, and lot coverage is 100%. The other setbacks meet the <br /> current zoning requirements under the bylaw. The percentage of the existing <br /> structures under the old calculation method for lot coverage is 5.3%. The total <br /> upland lot are is 34,000 sq. ft. The proposed lot coverage will increase to 11.6% <br /> and is well under the 20% requirement. <br /> The project was approved by the Conservation Commission with extensive <br /> mitigation conditions. The proposed structure is moving further away from the <br /> existing salt marsh; there is an IA septic system proposed. There are no new <br /> nonconformities being created and the project is consistent with other <br /> redevelopment in the neighborhood that was approved by the Board. <br /> Attorney Kirrane provided the Board with his narrative that the proposed new <br /> home will be beneficial, and will not be substantially more detrimental than <br /> what currently exists. <br /> Mr. Reidy read the Board of Health and Conservation Department comments <br /> into the record. <br /> Attorney Kirrane mentioned to the Board that the Health Agent reviewed the <br /> revised plans that were submitted the same day, and were stamped with the <br /> revised date. <br /> Mr. Bertolo with JC Engineering stated that the Conservation Commission <br /> limited the construction to four bedrooms. He stated that part of Concom's <br /> approval, they requested a revised site plan which was submitted earlier the <br /> same day as the Zoning Board meeting to address the changes. The site plan <br /> had to meet regulation 31 of the Concom regulations that there is not more <br /> than 10% of grass area, and the lot itself had 19,000 sq. ft. of grass area that <br /> potentially could be subject to nitrogen fertilizer. The site plan was re-submitted <br /> with the highlighted areas to depict the limit of the proposed areas of grass. <br /> Because there was a time limit with both Boards scheduled meetings, the site <br /> plan will need to be revised and re-submitted. <br /> 12 <br />
