MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 9, 2025 <br /> 2. Site Plan - Prepared for New Seabury Homes, Date: December 11, 2024. <br /> Prepared by: BSC Group, Stamped and signed by: Kieran J. Healy <br /> Professional Land Surveyor, and Brian G. Yergatian, Professional <br /> Engineer. <br /> 3. The Board finds under §174-17 that the proposed project is not <br /> substantially more detrimental to either the Town or the neighborhood. <br /> Ms. Sangeleer second. All were in favor. <br /> 14 Brewster Road <br /> Ms. Ingrid Spillane, the owner of the property presented the Written Finding <br /> request for a farmer's porch. The house required some minor repairs especially <br /> to the front entry way, and Ms. Spillane would like to extend the pre-existing <br /> nonconforming condition for additional living space. <br /> Mr. Morris commented that there is a utility easement that runs along the front <br /> of the road and two existing houses. This easement is a paved road so that <br /> trucks can access the utility lines. This is unfortunate for these two existing <br /> homes. <br /> Mr. Reidy read the Conservation Department comments into the record; "Not <br /> within wetland jurisdiction". Board of Health comments were read into the <br /> record. "No increase in habitable space, no comment." <br /> Mr. Furbush confirmed that the existing home is on a corner lot. Mr. Morris <br /> said that the home requires 40 ft. under the bylaw from both sides of the road. <br /> Mr. Morris stated that the home is pre-existing nonconforming, and that the <br /> applicant has a right to extend under the Written Finding criteria. The Board <br /> has to determine if it is detrimental to the neighborhood. <br /> The Board determined that the proposed project is not encroaching on the <br /> existing setbacks, therefore there are no new nonconformities being created, <br /> and the lot coverage is not increasing the 20% requirement. <br /> There were no comments from the audience. There were no more comments <br /> from the Board or Mr. Morris. <br /> Mr. Bonvie asked for a motion to close the public hearing. Mr. Furbush so <br /> moved. Ms. Sangeleer second. All were in favor. <br /> 3 <br />
