MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 23, 2025 <br /> Mr. Reidy read the Board of Health comments into the record; "No Change <br /> in Bedroom count to remain 3 bedroom." <br /> Mr. Reidy read an abutter letter into the record. <br /> The Board read the modification requirements noted in the bylaws for the record. <br /> Mr. Bonvie asked Mr. Dibb to explain the drainage study. <br /> Mr. Dibb said that there's a swale; and in his opinion the water will flow toward <br /> the basin and will not get to the property line and will flow behind the house. <br /> Mr. Furbush is concerned about the drainage for the abutters. <br /> Mr. Kirrane stated that the wall was originally 15 ft. from the property line, and <br /> will now be 28 ft. from the property line and is now an improvement to the <br /> abutters. <br /> Mr. Reidy reminded the Board the reason for this discussion is to determine if <br /> the plans are considered a minor or a major change, but does the Board have to <br /> consider the effect that may happen with these changes. <br /> Mr. Morris stated that he is relieved with these changes and will require an <br /> elevation certificate for FEMA records. <br /> Mr. Reidy made a motion to agree that the application is considered minor. Mr. <br /> Ganzenmuller agreed it is minor, Mr. Furbush agreed it is minor, Ms. Sangeleer <br /> agreed it is minor and Mr. Bonvie agreed it is a minor modification. <br /> Mr. Bonvie asked for a motion for the application. <br /> Mr. Reidy made a motion that the Board accepts the site plans and the plans <br /> submitted this evening, and that the Board will not accept any legal <br /> responsibility for any ultimate issues that may occur, and that the homeowner <br /> is aware of any and all issues that have been discussed. <br /> Mr. Furbush second.
