MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 23, 2025 <br /> Mr. Kirrane provided the house plans that were approved highlighted in yellow; <br /> the changes highlighted in pink. The original approved plan (Page 3) were the <br /> elevations, and page 4 of the plans depicted a garage on the first floor with a car <br /> lift that would move the cars to the basement. The new plans Al.1 and A.2 now <br /> depict moving the garage down to the basement floor, getting rid of the car lift, <br /> and now there will be living space above garage. The design changes are now a <br /> dining room, mud room and laundry. There are also changes to the fagade adding <br /> two new windows. <br /> Mr. Bonvie asked if there were changes made to the site plan and drainage. <br /> Mr. Kirrane said that the original garage design would not work in a flood zone. <br /> Mr. Mark Dibb described the changes to the site plan. There were some walls <br /> and some stairs over to the side. The proposal now depicts the driveway is just <br /> sloped slightly toward the well, and any runoff will flow through to the vegetated <br /> area. <br /> Mr. Bonvie is concerned with garage floors below grade and could cause drainage <br /> issues. He's concerned for a homeowner; I'm on the record saying it, and he does <br /> not want the Board or the Town to be liable for any drainage issues. <br /> Attorney Kirrane made note and mentioned this modification is before the Board <br /> that there is no setback changes proposed and there's no lot coverage changes <br /> proposed. <br /> Ekatarina Labovikj-Cook with Archi-Tech Associates stated for the record that <br /> the clients have seen and approved the new design, and accepts the risk with <br /> the possibility of water flowing into their house. <br /> Mr. Dibb stated that the homeowners are aware that the elevation was 6 ft., and <br /> now it is 9 ft., and the flood zone is 11 ft. <br /> Mr. Bonvie was adamant that the Town and the Board do not want to accept <br /> liability, and is on the Engineer. <br /> Mr. Reidy read the Conservation Department comments into the record, "The <br /> Commission issued an Order of Conditions for this project on 5120124. Any <br /> revised plans that differ from the Plan of Record presented to the Conservation <br /> Commission must be provided to Conservation staff for review." Also, an <br /> Administrative Approval from the Assistant Conservation Agent dated May 16, 25 <br /> was read into the record". <br /> 7 <br />
