MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 23, 2025 <br /> Mr. Brian Wallace, Engineer with J.C. Engineering represented the homeowners, <br /> David and Dianne Bazarian who were also present. The project consists of <br /> removing the existing dwelling and replacing it with a new two-story dwelling on <br /> the existing foundation. There is a nonconformity on the left side setback at 13 <br /> ft. where 15 ft. is required. The project received Conservation Commission <br /> approval. The project will not cause any disturbance of ground area around the <br /> house. The Board of Health will require an upgrade to an IA system, and can <br /> approve a retro-fit of the existing Title 5 System. <br /> Mr. Reidy read the Conservation Department comments into the record; "This <br /> project was issued an order of conditions by the Commission at their June 261n <br /> public meeting. No mitigation required." <br /> Mr. Reidy read the Board of Health comments into the record; "Raze and Replace <br /> will trigger the IA 1000`Regulation requiring Nitrogen Removal to be added to the <br /> Septic. House to Remain 3 bedroom." <br /> Mr. Goldstein asked if the covered porch is an extension. Mr. Wallace said yes, <br /> the porch is being constructed on sono tubes, and the porch will be setback 20 <br /> ft.; the setback is 25 ft. in the Popponesset Overlay District. <br /> Mr. Goldstein wanted confirmation that the house will remain under the <br /> maximum height restriction of 30 ft. Mr. Wallace said; yes, with the existing <br /> foundation remaining. <br /> Mr. Bonvie wanted to confirm that the Board of Health is allowing a <br /> sledgehammer system, and asked if the application includes that the existing <br /> foundation is remaining. Mr. Wallace said; yes. <br /> Mr. Bonvie also questioned that the 10-in., no footing, no steel foundation <br /> remaining. <br /> Mr. Wallace stated that a structural engineer assessment was performed. <br /> Mr. Bonvie mentioned from his experience that building atop an existing <br /> foundation could be detrimental. He mentioned that if the decision is to remove <br /> the foundation, it would be a whole new application to file with the ZBA. <br /> Depending upon whether this board determines it's a major change or minor <br /> change you could be two or three months into a process and asked for the <br /> Building Commissioner comments. <br /> 4 <br />
