Minutes of Meeting of <br /> Plan Review Committee <br /> Tuesday, June 3, 2025 <br /> Mashpee Town Hall Waquoit Meeting Room <br /> Mr. Tobin mentioned thatthere was an ANR plan created and thatthere was a restriction <br /> placed that there is no access allowed from Rte. 28. <br /> Mr. Dibb said that the particular version of that plan wasn't restricting access. Mr. <br /> Bogosian said thathewould haveto haveapproval from DOT andlocal officialsfora curb <br /> cu t. <br /> Mr. Tobin said that the curb cut is a separate issue from the (ANR) Approval Note <br /> Required plan. He said that the ANR plan was created 20 years ago by the Planning <br /> Board at that time restricting access to Rte. 28. <br /> Mr. Bogosian said that he had a discussion with his Attorney,and thatsince this property <br /> is now being utilized there should be a list of items that can be approved and conditioned <br /> during the permitting process. <br /> Mr. Tobin wants a copy of that ANR plan. Mr. Dibb said he will provide that. <br /> Ms. Laurent mentioned that an ANR plan can be conditioned,and the question is it legal <br /> and enforceable.Atthe time, was there strictly a division of property and does it meet the <br /> requirements. <br /> Mr. Dibb mentioned that that back in 2019 the ZBA approved a different bu ilding on this <br /> site, and from a surveying standpoint, if an ANR has some terminology about no access <br /> on Rte. 28, but it was just a statement, not a restriction at that time. He believes there is <br /> an answer to this question and can provide answers. <br /> 5 <br />
