MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 13, 2025 <br /> 868 Falmouth Road: Petitioner, NextGrid Tung Oil, LLC requests a Modification <br /> to the existing Special Permit (SP-92-53), and (SP-84-10-042) to allow for <br /> installation of five (5) large-scale ground mounted solar panels akin to carport <br /> structures at the rear of the existing storage facility. This modification also <br /> includes two waiver requests presently pending before the Planning Board; First <br /> waiver request for setback relief from (Section 174-45.C.2.c), 100 feet to <br /> approximately 63 ft. setback for solar PV carport structures. The second waiver <br /> request for maximum structure height (§174-45.7 C2.g), allowance from 15 ft. <br /> up to 23 ft. of clearance for RV and boat storage on property located in an I-1 <br /> Zoning District, Map 88, Parcel 2A, Mashpee, MA. Planning Board will vote on <br /> waivers only at its meeting on August 6, 2025 in the Waquoit Room of Town <br /> Hall, 16 Great Neck Road, Mashpee, MA 02649 and welcomes public comment <br /> at this meeting. ZBA will incorporate Planning Board waiver vote into its final <br /> modification decision. <br /> Mr. Mike Patterson with NextGrid and Melinda Costello with Weston &, Sampson <br /> presented their request for a modification to the existing Special Permit for the <br /> solar project that consists of development and construction of a rooftop and <br /> carport mounted solar array that includes five car ports. It also has rooftop <br /> mounted and a battery system. There are also two waivers; one for the 100 foot <br /> setback to the R3 district to the south as well as the 15 ft. structure height which <br /> were approved by the Planning Board last Wednesday, August 6tn. <br /> Chairman Bonvie said it is his opinion that the Planning Board does have a <br /> right to issue those waivers. A copy of the Special Permits were included in the <br /> binders submitted by the applicants. <br /> Mr. Reidy read the Board of Health comment; "No comment, and Conservation <br /> Department comments; "Not in wetlands jurisdiction". There was also a <br /> document submitted by Pesce Engineering responding to comments submitted <br /> by Weston 8v Sampson. <br /> Mr. Bonvie wanted to know if Pesce Engineering was satisfied with all the <br /> engineering aspects of the project. <br /> Mr. Furbush wanted to know if the Board considers the application as minor <br /> or major. The applicants submitted a signed petition for a "Modification" and <br /> was advertised as a "Modification". The Board considered this a major <br /> modification because the abutters were required notification of the petition and <br /> hearing. <br /> Mr. Patterson commented that the Design and Plan Review Committees <br /> reviewed this project and submitted their recommendations to move forward <br /> with the project. <br />
