MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 13, 2025 <br /> The Board of Health comments dated August 11, 2025 were read into the record; <br /> "House to remain three bedrooms, one on the first floor and two on the second <br /> floor. Change in footprint requires a title 5 inspection to be completed." <br /> The Board read the Conservation Department comments dated August 12, 2025 <br /> into the record; "Resource area LSCSF. NOI application was approved with the <br /> unanimous vote by the commission due to flood compliance foundations and <br /> increase in naturally vegetated areas on the property with conditions to revise <br /> planting plan with ground cover and anchor the shed to the ground." <br /> Chairman Bonvie asked Mr. Cook how he calculated lot coverage. Mr. Cook said; <br /> the engineer calculated lot coverage with the new additions, the deck and the <br /> house. He didn't have contact with the engineer. <br /> Mr. Furbush asked what percent of the lot is subject to coastal storm flowage. <br /> Mr. Cook said; 100% of the lot. <br /> Mr. Bonvie explained that the 100% lot coverage within coastal storm flowage <br /> should be depicted on a plan. The building maximum lot coverage is 20%, and <br /> is considered the old calculated method. Mr. Bonvie stated as one member, he <br /> is comfortable that the plan can be corrected without having to come back to the <br /> board. He explained that the Board lost a court case two years ago regarding <br /> properties that were subject to coast storm flowage. <br /> The plan should depict lot coverage as 100% existing and 100% proposed and <br /> also should depict building coverage 20%, there is no maximum just building <br /> coverage existing at 13.8% and proposed 18.7% take out the word "maximum" <br /> because there is no maximum; it's technically not a zoning issue it's for the Board <br /> to understand. <br /> Mr. Bonvie wanted to discuss roof drainage. <br /> Mr. Cook said the plan does not show any drywells, it's just drip edge. There's <br /> no gutters on the house at all. It's all stone around the house if you look at a <br /> photograph. <br /> Ms. Sangeleer said she noticed there was no lawn and that the property is all <br /> crushed stone <br /> Mr. Cooks said that the deck is going to be replaced in the same footprint. There <br /> are two proposed additions and a replaced deck. <br /> 2 <br />
