MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 13, 2025 <br /> Mr. Bonvie asked for a motion for the application. <br /> Mr. Reidy mad a motion that the Board issue a Written Finding under §174-17 <br /> and §174-33 to Owners, Chase Anders Vajcovec and Jessica Lyn Vajcovec to allow <br /> for construction of a 240 sq. ft. addition replacing an existing deck on property <br /> located in an R-3 Zoning District, Map 125, Parcel 81, Mashpee, MA with the <br /> following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Written Finding under Mass General Law 40A Section 6. <br /> 2. Plot Plan - 45 Manitoba Road, Prepared for Josephine Foster, Prepared by: <br /> All Cape Septic and Survey, Date: May 2, 2025, Stamped and signed by: <br /> Stephen Moore, Land Surveyor, No.: 39808. <br /> 3. Building Plans - Vajcovec Residence, 45 Manitoba Rd, New Addition. <br /> Prepared by: Cotuit Bay Design, LLC, Scale: 1/4" = V, Date: 5/20/25, <br /> Drawing No.: Al: First Floor Plan, Al: Front, Left, Rear, and Right <br /> Elevations. <br /> 4. Conditioned on all Town Department comments read into the record <br /> including but not limited to the Conservation Department and Board of <br /> Health. Also conditioned upon submission of modified plans relative to the <br /> fireplace, and the calculations as discussed at the time of the meeting. <br /> Such plans to be submitted to our Chair who will have authority to sign <br /> them. <br /> 5. Any changes to the plans will require the applicant to return to this Board <br /> other than the two plans as discussed during the hearing. <br /> 6. Conditioned that the applicant seek and obtain the Building Department <br /> review in reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior <br /> to the application of a building permit. <br /> 7. The Board finds under §174-17 and §174-33 that the proposed project is <br /> not substantially more detrimental than the pre-existing, nonconforming <br /> structure or use to either the Town or the neighborhood. <br /> Ms. Sangeleer second.
