MASHPEE ZONING BOARD OF APPEALS MEETING MINUTES AUGUST 13, 2025 Mr. Bonvie asked for a motion for the application. Mr. Reidy mad a motion that the Board issue a Written Finding under §174-17 and §174-33 to Owners, Chase Anders Vajcovec and Jessica Lyn Vajcovec to allow for construction of a 240 sq. ft. addition replacing an existing deck on property located in an R-3 Zoning District, Map 125, Parcel 81, Mashpee, MA with the following conditions: 1. The Board has determined that the applicant meets all the conditions of a Written Finding under Mass General Law 40A Section 6. 2. Plot Plan - 45 Manitoba Road, Prepared for Josephine Foster, Prepared by: All Cape Septic and Survey, Date: May 2, 2025, Stamped and signed by: Stephen Moore, Land Surveyor, No.: 39808. 3. Building Plans - Vajcovec Residence, 45 Manitoba Rd, New Addition. Prepared by: Cotuit Bay Design, LLC, Scale: 1/4" = V, Date: 5/20/25, Drawing No.: Al: First Floor Plan, Al: Front, Left, Rear, and Right Elevations. 4. Conditioned on all Town Department comments read into the record including but not limited to the Conservation Department and Board of Health. Also conditioned upon submission of modified plans relative to the fireplace, and the calculations as discussed at the time of the meeting. Such plans to be submitted to our Chair who will have authority to sign them. 5. Any changes to the plans will require the applicant to return to this Board other than the two plans as discussed during the hearing. 6. Conditioned that the applicant seek and obtain the Building Department review in reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior to the application of a building permit. 7. The Board finds under §174-17 and §174-33 that the proposed project is not substantially more detrimental than the pre-existing, nonconforming structure or use to either the Town or the neighborhood.
