Its all based on relative <br /> elevation. On Sheet C101, the south side existing grade elevation is 23ft., 58 feet would be <br /> max height of the parking structure with the array. The residential lots are even lower, further <br /> south of that line, so there is only a three-foot difference between the tree canopy and the <br /> panels. <br /> Mr. Tobin read the provision of the code where fixed tilt ground mounted shall have a <br /> maximum height of 15ft. The Planning Board may increase maximum height should they see <br /> fit. It doesn't say you can grant for fixed panels, it does say rotating single or dual access <br /> ground energy systems. He asked if the Board was comfortable granting a waiver for fixed <br /> mounted, based on wording of the code in that section. <br /> Ms. Waygan answered, as the drafters of this, they are okay with going forward on this. This <br /> would be considered under a Special Permit of the Planning Board next round, and legal <br /> counsel has given a pathway forward. She is not comfortable with this approach forever, but <br /> we will entertain those requested waivers, with what we have currently. She doesn't ever recall <br /> trying to distinguish between the two. <br /> Mr. Pesce noted Section F is a catch all, waivers can be given to any. Mr. Tobin agreed that <br /> Section F could apply based on Board interpretation, or the Board could find the other section <br /> to be a limitation to it, given the three-foot difference between the panels and the tree tops. <br /> Mr. Balzarini asked where the collected energy goes.
