Conditioned that the applicant seek and obtain the Building Department <br /> review in reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior <br /> to the application of a building permit. <br /> 7. The Board finds under §174-17 and §174-17.1 that the proposed project <br /> as submitted is not substantially more detrimental to the neighborhood <br /> than the existing conditions prior to removal of the existing structure, and <br /> that there is adequate land area on the subject lot to provide sufficient <br /> parking, and there are no new nonconformities being created. <br /> Ms. Sangeleer, second. Pilpel request a Written <br /> Finding under §174-17 of the Zoning Bylaws to allow for an addition on the right <br /> front side of a pre-existing nonconforming structure, and reconfiguring of an <br /> existing deck on property located in an R-5 Zoning District, Map 27, Parcel 97, <br /> Mashpee, MA. (Continued from July 23, 2025 at the request of the <br /> Attorney). <br /> Attorney Kirrane requested a continuance until the application is reviewed by <br /> Conservation. <br /> Mr. Morris commented that the existing plot plan of the porch depicts a distance <br /> of 36.8 from the stairs, but the proposed dimension depicts 36 ft., and might be <br /> considered a new nonconformity. <br /> Attorney Kirrane will consult with the engineer to review the dimensions. <br /> Mr. Bonvie asked for a motion to accept the continuance until November 12, <br /> 2025.
