MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> SEPTEMBER 10, 2025 <br /> Mr. Wolfe asked for a continuance until Wednesday, November 12, 2025. <br /> Mr. Bonvie asked for a motion to accept the continuance. Mr. Furbush so moved. <br /> Ms. Sangeleer second. All were in favor. <br /> 45 Nehoiden Road: Owner, Richard H. Gorbaty requests a Written Finding <br /> under §174-17 of the Zoning Bylaws to allow for construction of a front entry <br /> addition in place of an existing deck, a living room addition in place of the rear <br /> deck, and a bathroom addition to the primary bedroom on property located in <br /> an R-3 Zoning District, Map 125, Parcel 116, Mashpee, MA. <br /> Mr. Geoff Bright represented the homeowners for their Written Finding <br /> application. The project consists of an extension of the front entry, <br /> reconstruction of the rear deck, and an addition with a new pier foundation in <br /> the rear of the existing dwelling. <br /> Mr. Bright had a conversation with the Conservation Agent and will be filing an <br /> RDA that is scheduled for October 9, 2025. After discussing the project with the <br /> Agent, he was told that the project could be heard by the ZBA, and that there <br /> should be no issues. The Conservation Department comments were revised. <br /> Mr. Reidy read the Board of Health comments into the record; The proposed <br /> additions do not have a foundation therefore no septic setbacks are infringed <br /> upon so no septic inspection is required. Floor plans do not indicate any <br /> additional bedrooms so no increase in flow." <br /> Mr. Reidy read the Conservation Department comments into the record; <br /> "Property lies within the AE flood zone, which is jurisdictional wetlands. A permit <br /> filing with Conservation will be required (RDA-Request for Determination of <br /> Applicability). The Conservation Dept. recommends that the ZBA proceed with their <br /> review of this project at their upcoming meeting prior to the hearing before concom, <br /> which won't be until Oct. 9th. This project is pretty straightforward and we don't <br /> anticipate any issues from the concom with this project as currently presented. " <br /> Mr. Bonvie polled the Board for their opinion regarding the review of the project. <br /> Typically the Board does not render a decision until there are approvals <br /> submitted by Concom. <br /> 5 <br />
