Explanation: This article proposes to amend the Town’s Zoning Bylaw to update Stormwater <br />Management Regulations related to standards for post-construction stormwater management in new <br />development and redevelopment to better align with MADEP and the Environmental Protection <br />Agency’s (EPA’s) General Permit for Small Municipal Separate Storm Sewer System (MS4) in <br />Massachusetts (MS4GP) permitting (better known as the “MS4 Permit”). The primary goals of these <br />updates are to provide a clearer bylaw for residents and contractors, to meet permit update <br />requirements and to improve the efficient and coordinated administration of the Bylaw. Article 9 <br />requires a 2/3 vote to pass <br /> <br /> <br />The Select Board recommends approval of Article 9 by a vote of 5-0 <br />The Finance Committee recommends approval of Article 9 by a vote of 4-0 <br /> <br />The Planning Board unanimously recommends approval of Article 9 <br /> <br />Motion made by Select Board Member Richardson <br /> <br />Motion: I move the Town vote to approve Article 9 as printed in the warrant, with the <br />exception of the phrase “or take any other action relating thereto.” <br /> <br />Motion passes 338 to 55 at 8:40PM <br /> <br /> <br />Article 10 <br /> <br />To see if the Town will vote to amend the General Bylaws as follows: <br /> <br />Amend Chapter 120, §120-1 Excessive or Unusual Noises by adding the following new subsections <br />after subsection B: <br /> <br />C. Construction, demolition, and commercial landscaping activity are allowed to operate any tools <br />or equipment used in construction, demolition, or commercial landscaping work in the Town of <br />Mashpee between the hours of 7:00 a.m. and 7:00 p.m. on weekdays (Monday thru Friday) or <br />between the hours of 8:00 a.m. and 7:00 p.m. on any other day. Any person violating this subsection <br />may be punished by a fine of fifty dollars ($50) for each offense. Each day a violation occurs shall <br />be a separate offense. <br /> <br />D. Persons shall operate, on their own property, any power tool or any garden tool, leaf blower, <br />chain saw or similar device powered mechanically, by electricity, gasoline, diesel or other fuel, <br />outdoors in a zoned Residential District between the hours of 7:00 a.m. and 8:00 p.m. Any person <br />violating this subsection may be punished by a fine of fifty dollars ($50) for each offense. Each day <br />a violation occurs shall be a separate offense. <br /> <br />E. Non-Criminal Disposition - Whoever violates any provision of this by-law may be penalized by <br />a non-criminal disposition process, as provided in M.G.L. c.40 §21D and the Town’s non-criminal <br />disposition by-law. <br /> <br />Or take any other action relating thereto. <br /> <br /> Submitted by the Board of Health <br /> <br /> <br /> <br />
