<br />Explanation: This amendment to the Noise Control By-law provides a more comprehensive <br />regulation of unnecessary, excessive, loud and unusual noises from construction, demolition or <br />commercial landscaping activity. As the by-law is currently written, noise created by things other <br />than any radio, phonograph or other mechanical sound-making device or instrument or reproducing <br />device or instrument, or in the play of any band, orchestra, musician or group of musicians, or in the <br />use of any device to amplify the aforesaid, or the making of loud outcries, exclamations or other <br />loud or boisterous noises, or the loud and boisterous singing by any person or group of persons or <br />in the use of any device to amplify the aforesaid noise, it is not covered. So at this time the <br />Departments have no verbiage to follow/enforce when receiving a complaint about noise coming <br />from construction, demolition or commercial landscaping activity. <br /> <br />The Select Board recommends approval of Article 10 by a vote of 5-0 <br />The Finance Committee recommends approval of Article 10 by a vote of 4-0 <br /> <br />Motion made by Select Board Member Wyman-Colombo <br /> <br />Motion: I move the Town vote to approve Article 10 as printed in the warrant, with the <br />exception of the phrase “or take any other action relating thereto.” <br /> <br />Elana Doyle made a motion to amend Article 10 Section D by striking 8:00pm and adding in <br />its place 10:00pm. <br /> <br />Motion to amend fails by a vote of 182 to 189 at 8:42PM <br /> <br />Original motion passes 212 to 110 at 8:47PM <br /> <br /> <br />Article 11 <br /> <br />To see if the Town will vote to amend Chapter 106 of the General Bylaws by amending §106-8 <br />Rental Property, by inserting the bold, underlined text, as follows: <br /> <br />G. Inspections <br /> <br />1) Dwelling units covered by this by-law shall be subject to inspection at reasonable times by <br />a Building Official and a Board of Health Agent/Inspector for the facilities initial <br />inspection. After the initial inspection, required annual inspections will be conducted by the <br />Building Officials, and at their discretion, may request other inspectional service personnel <br />(Health, Electrical, Plumbing and/or Fire Departments) to accompany them to the property for <br />inspection. All interior inspections shall be done in the company of the owner(s), occupant(s) or the <br />representative of either. <br /> <br />2) Required inspections by inspectional services personnel shall occur within the timeframe and at <br />intervals determined by 780 CMR Table 110: Schedule for Periodic Inspection of Existing <br />Buildings. <br /> <br />3) Health inspections shall be performed in accordance with Chapter II of the State Sanitary Code <br />105 CMR 410.000. <br /> <br />4) Building inspections shall be performed in accordance with the State Building Code 780 <br />CMR: State Board of Building Regulations and Standards. <br /> <br />
