<br />And, to replace in each instance in which they appear referring to the issuance of a Rental Certificate, <br />the words “Board of Health” with “Building Department,” throughout the bylaw. <br /> <br />Or take any other action relating thereto. <br /> <br /> Submitted by the Board of Health <br /> <br />Explanation: This amendment to the Rental Properties Bylaw allows the Town to keep up with the <br />State Code 780 CMR. The new state code requires all short-term rental properties to be inspected <br />by a building official. A building official is defined in M.G.L Title XX Chapter 143, Section 3. Per <br />the 780 CMR Table 110, these rentals are to be inspected, at a minimum, once per year by the <br />Building Official. These new amendments also require that the Health Department accompany the <br />Building Official on the initial inspection of the facility’s permitting. Each subsequent year, <br />inspection will only be conducted by the Building Official, unless they request to be accompanied <br />by other inspectional services personnel. <br /> <br />The Select Board recommends approval of Article 11 by a vote of 5-0 <br />The Finance Committee recommends approval of Article 11 by a vote of 4-0 <br /> <br />Motion made by Select Board Member Weeden <br /> <br />Motion: I move the Town vote to approve Article 11 as printed in the warrant, with the <br />exception of the phrase “or take any other action relating thereto.” <br /> <br />Motion passes 289 to 46 at 8:49PM <br /> <br /> <br />Article 12 <br /> <br />To see if the Town will vote pursuant to G.L. c. 43B, § 10A to amend the Town Charter, which <br />Charter is available in the office of the Town Clerk and on the Town’s website at <br />https://www.mashpeema.gov/sites/g/files/vyhlif3426/f/uploads/mashpee_charter.pdf: <br /> <br />To revise SECTION 1-7, sub-section (o): DEFINITIONS by amending the definition of “Town <br />Bulletin Boards” by inserting the below paragraph numbering and the italicized and bold text, as <br />follows: <br />Town Bulletin Boards – the words “town bulletin boards” shall mean: <br />1. the bulletin board at the town hall on which the Town Clerk posts official notices of meetings <br />and upon which other official town notices are posted; and <br />2. the town’s official website, as designated by the Select Board, provided the Town’s official <br />website is functioning and operational; and <br />3. the bulletin boards at any other locations as may be designated town bulletin boards by the <br />Select Board. <br /> <br />To revise SECTION 3-4: TOWN CLERK by amending subsection (b) “Powers and Duties” by <br />inserting the italicized and bold text, as follows: <br /> <br /> <br /> <br />
