MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY, 26, 2025 <br /> 7. The Board finds under §174-17.1 and §174-33 that the proposed project <br /> as submitted is not substantially more detrimental to the neighborhood <br /> than the existing conditions prior to removal of the existing structure, and <br /> that there is adequate land area on the subject lot to provide sufficient <br /> parking, and there are no new nonconformities being created. <br /> NEW HEARINGS <br /> 105 Waterway: Owners, Domenic J. and Kathleen A. Venuto request a Written <br /> Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for <br /> construction of a garage addition, extension, to a pre-existing, nonconforming <br /> structure on property located in an R-3 Zoning District, Map 105, Parcel 252, <br /> Mashpee, MA. <br /> Owners, Domenic and Kathleen Venuto presented their Written Finding request <br /> for an attached one garage underneath the pre-existing non-conforming house. <br /> They provided a site plan that depicts the existing and proposed <br /> Mr. Morris, Building Commissioner told the Board that the project is located <br /> within the flood zone and requires a Written Finding under Section 174-33. The <br /> project involves construction of four walls that require to be flood zone compliant <br /> with flood vents, but they are not structural walls. He has no issues, but it <br /> requires Zoning Board approval. <br /> Chairman Bonvie asked if the project was approved by Conservation. Ms. Venuto <br /> said; yes. <br /> Mr. Reidy read the Board of Health comments into the record; "No Comment No <br /> increase in habitable space house to remain 3 bedroom." <br /> Mr. Reidy read the Conservation Department Comments into the record; <br /> "Resource Areas:LSCSF. RDA application received a negative determination from <br /> the commission due to the garage being proposed in existing dwelling footprint." <br /> 4 <br />
