Conditioned that the applicant seek and obtain the Planning Department review in <br /> reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior to the application of a <br /> building permit. <br /> 8. The Board finds under §174-17 and §174-33 that the proposed project as submitted is not <br /> substantially more detrimental than the pre-existing, nonconforming structure or use to <br /> either the Town or the neighborhood. <br /> Mr. Furbush, second. All were in favor. <br /> 89 Industrial Drive: Petitioner, Steven P. Hynds requests a Modification to the existing Special <br /> Permit(s) (SP-2022-52), under §174-25 G (6), and G (9) of the Zoning Bylaws to allow for boat <br /> storage of up to (20) twenty boats inside contractor bays and outside (Item 11 of Special Permit <br /> only allows one(1)boat to be stored),on property located in an I-1 Zoning District,Map 88,Parcel <br /> 27, Mashpee MA. (Owner of Record: 11 Industrial Drive, LLC). <br /> Sitting on this hearing are the three regular Board members, and Associate Members, Mr. <br /> Ganzenmuller, and Mr. Morizio. <br /> Mr.Hynds presented his request for a modification.Also present was Mr. Kelly who services boats <br /> at New Seabury Marina who would like to store boats at 89 Industrial Drive. <br /> Mr. Bonvie asked for letters to the Board. <br /> Mr. Ganzenmuller read a letter into the record dated November 11, 2025, from Mr. John Fish who <br /> has issues with the property. <br /> Mr. Reidy read the Board of Health and Conservation Department comments into the record. No <br /> comment from the Board of Health, and not in wetlands jurisdiction. <br /> Mr. Bonvie wanted to know if the Fire Department commented. Mr. Hynds said he reached out to <br /> the Fire Department, but had not heard yet. <br /> Mr. Hynds mentioned that he did not want to store boats inside but his original application has a <br /> written note requesting "both inside and outside". The Board had concerns with the storage of <br /> boats inside the contractor bays, and the fact there was no indication on the site plan where the <br /> boats will be stored outside. The Board also wanted comments from the Fire Department for truck <br /> access. <br /> 4 <br />
