Town of Mashpee Conservation Commission
16 Great Neck Road North
Mashpee, MA 02649
Commission, while noting existing neighbor relations. The presence of phragmites near the wetland edge was
also discussed, and potential treatment was raised as a possible condition.
The Commission noted that the site had not been staked at the time of site visits, limiting the ability to
identify regulatory boundaries and areas of proposed work. Commissioners expressed general support for the
reduced footprint, stormwater controls, septic upgrade, and restoration effort, while emphasizing the need for
careful consideration of the waiver request and potential conditions related to restoration success and invasive
species management.
MOTION: To close an issue at 126 Waterway with the following
conditions:
1. Three-year monitoring plan for the restoration
2. For the engineer to consult with staff on the high-tide bushes on the lawn area
3. Treatment plan for the phragmites
Motion bv: Richard Sahl Seconded bv: Sandi Godfrey
Discussion: Discussion clarified that the encroached lawn area would be
eliminated and replanted with high-tide bushes, consistent with Conservation
staff recommendations. Commissioners expressed support for this approach,
noting that lawn areas adjacent to the water often involve fertilizer use and
can negatively impact water quality, and agreed that restoring the area with
native vegetation would be preferable.
Vote: Motion passed by unanimous vote.
(Sarah Thornbrugh, Paul Colombo, Sandi Godfrey, Richard Sahl,
Seana Pitt)
----------------------------------------------------------------------
COC 24 Spoondrift Way, Mark Edward Sr. & Barbara Jo Ann Jennings. Proposed
bulkhead (seawall). (Representative: Mark Jennings) 43-
1146
The original Order of Conditions dates to 1994 and authorized construction of a bulkhead.
Commissioners inquired about the current condition of the structure. Staff reported that the existing wooden
revetment/bulkhead is in good condition, with no signs of bulging, undermining, or hydrostatic pressure, and
appears structurally sound. It was noted that the request was likely prompted by an impending property sale, a
common circumstance with older Orders discovered during title review.
Staff explained that required documentation was incomplete. Specifically, an as-built plan was not
submitted, and because a Chapter 91 plan bearing an engineer's stamp is part of the original record, a
professional engineer sign-off letter is also required to certify compliance. The original engineer is retired;
however, staff has directed the applicant to coordinate with the successor engineering firm to provide both the
as-built plan and the certification letter.
Given the timing constraints associated with the pending purchase and sale and the Commission's next
meeting not occurring until January, staff recommended that the Commission consider approving the COC
subject to conditions, rather than denying or continuing the request. Commissioners discussed the process and
10
