MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 10, 2025 <br /> Mr. Bonvie asked the Board how to proceed. Mr. Reidy would like to see a <br /> rendering of the tent with the proposed elevation changes relative to the existing <br /> building and beach, and a rendering projected from the beach to the new tent. <br /> The Board had a discussion and recommended that the hearing be continued <br /> with the proposed changes to the plans and prefers that the architect be present <br /> at the next meeting to answer any questions. <br /> Mr. Reidy made a motion to accept the applicant's request to continue until <br /> Wednesday, January 14, 2026. <br /> 18 Starboard Lane Owner, Shallow Shores, LLC requests a Written Finding <br /> under §174-17 and §174-33 of the Zoning Bylaws to reconstruct an existing deck <br /> in the same footprint and add an enclosed porch over the existing deck on <br /> property located in the R3 and Popponesset Overlay Districts, Map 118, Parcel <br /> 12, Mashpee, MA. <br /> Attorney Christopher Kirrane represented the applicant. This project includes <br /> reconstruction of a deck, and enclosed porch under §174-17, and §174-33 in <br /> the Popponesset Overlay District. The property fronts both Starboard Lane and <br /> Wading Place and requires it to meet the minimum front yard setbacks from <br /> both streets. The existing nonconformities are the front yard setback from <br /> Wading Place at 18.1 ft., the westerly side yard setback is 14.9 ft., the existing <br /> deck is 3.7 ft. and lot coverage is partially impacted by the flood zone in the <br /> rear, the actual lot coverage is 26%, and the setback to wetlands is less than <br /> 50 ft. from the wetland with the small portion within the flood zone. <br /> The proposal consists of replacing the side deck in the same footprint, and <br /> enclosing the deck situated on the area of Wading Place. The narrative depicts <br /> a picture of the existing deck that will be replaced in the same footprint. <br /> Mr. Bonvie had a discussion with Attorney Kirrane and the Board regarding <br /> concerns with the late submittal of the department head comments <br /> (Conservation and Board of Health). Attorney Kirrane will reach out to Mary <br /> Ann the Wednesday prior to the meeting to confirm that comments were <br /> submitted by the department heads. <br /> Attorney Kirrane asked the Board to approve this project with the condition <br /> that the revised plan be submitted prior to issuance of a building permit. <br /> Mr. Reidy read the incorrect comments from Conservation and Board of Health. <br /> 8 <br />
