MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 10, 2025 <br /> Mr. Brian Yergatian, Engineer with BSC Group representing the applicant. This <br /> tent is located next to the Popponesset Inn and requires some major renovations. <br /> The existing site has several nonconformities: lot coverage, frontage, front and <br /> side yard setbacks. The primary reason for this application is the setback from <br /> the coast dune within the wetlands. The lot coverage will decrease slightly, and <br /> the setback will gain 4 ft. from the mean high water. The tent will be slightly <br /> smaller than the existing tent. The existing tent is currently situated on a <br /> concrete foundation and will be removed and replaced with pilings. The <br /> Conservation Commission approved the order of conditions in November. A <br /> portion of the building will be removed and depicted as hatched lines on the site <br /> plan. <br /> Mr. Yergatian noticed that the flood zone and structure coverage information was <br /> not depicted on the plan but will revise and submit a new plan. <br /> Mr. Yergatian mentioned that the new tent structure will be raised to the level <br /> of the existing building but cannot be connected to being FEMA compliant. <br /> The Conservation Department comments were read into the record; "Resource <br /> Areas: Coastal Dune, Coastal Bank, & LSCSF. NOI application was approved through a <br /> unanimous vote by the Commission. Project will improve resource area protection with a raised <br /> flood compliant foundation for the tent and enhancing natural vegetation on the coastal dune. <br /> Conditions of a three-year mitigation monitoring contact with a certified professional and <br /> permeable pavers on hardscapes. " <br /> The Board of Health comments were read into the record; "Not tinder Health <br /> Departments Purview." <br /> Mr. Furbush asked what the height of the tent would be and what it is <br /> currently. Mr. Yergatian said that the height will be approximately 28 ft. <br /> Mr. Morizio mentioned that the current height of the tent is 18-27 ft. <br /> The Board asked several design questions and confirmed that the tent is a <br /> seasonal structure. <br /> Mr. Morizio asked if there were any changes to the storm water management. <br /> Mr. Yergatian said that there are no proposed changes. The area is subject to <br /> LSCSF, but there will be substantial mitigation performed in that area. <br /> Mr. Morris mentioned that the current tent predates building codes, and he <br /> agrees that the tent should only be erected during the seasonal months and <br /> will require Fire Department inspections. <br /> 7 <br />
