MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 10, 2025 <br /> 10 Echo Road: Petitioner, Michael Zuniga requests a Modification to the <br /> existing Special Permit (SP-87-02-022) under §174-25 E 3 of the Zoning Bylaws <br /> to allow for boat trailer sales on property located in a C-2 Zoning District, Map <br /> 20, Parcel 25, Mashpee, MA (Owner of Record: Paul R. McGee, Trustee). <br /> Mr. Michael Zuniga presented his Modification request to the existing Special <br /> Permit. He bought the existing boat trailer business early in the year and had to <br /> register with the Town and the State RMV. He had a discussion with the Building <br /> Commissioner, who determined that the existing Special Permit did not <br /> specifically document the existing use of this property and therefore suggested <br /> that a Modification is warranted. <br /> The Board had a discussion to confirm that there are currently retail sales <br /> allowed in the C-2 Zone area, and that this business has been in existence for <br /> over 20 years. The Board had further discussion with the applicant and agreed <br /> it would be beneficial to conduct boat trailer and utility trailer sales at this <br /> location. <br /> The Board of Health and Conservation Department comments were read into the <br /> record; "No issues with Board of Health", and Conservation Department, not in <br /> wetlands jurisdiction." <br /> There were no more comments from the Board. <br /> Mr. Bonvie asked for a motion to close the public hearing. Mr. Furbush so moved. <br /> Mr. Caggiano second. <br /> Mr. Bonvie asked for a motion for the application. <br /> Mr. Reidy made a motion that the Board issue a Modification with the following <br /> conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Modification to the existing Special Permit under Mass General Law 40A <br /> Section 9. <br /> 2. Conditioned on all Town Department comments read into the record <br /> including but not limited to the Conservation Department and Board of <br /> Health. <br /> 3. The Board finds under §174-25 E3 that the proposed Modification is not <br /> substantially more detrimental than the pre-existing use to either the <br /> Town or the neighborhood. <br /> 4 <br />
