Applicant: Mashpee Commons Limited Partnership <br /> Location: West of Market Street & North of Jobs Fishing Road <br /> Assessors Map 74, Blocks 20 & 20-B <br /> Request: Several small parcels of land in Mashpee Commons to be evenly traded <br /> between the special permit area & the comprehensive permit area. <br /> Present this evening for the applicant is Tom Bunker with BSS Design, and he has been <br /> working on this plan for two years. The retail area has a Special Permit for all of the buildings. <br /> He showed a colored plan on the screen, representing the area of the 40B Comprehensive <br /> Permit and the Special Permit. There are two sets of plans, most of what is referred to as <br /> Mashpee Commons and the 40B by Route 28 is registered with Land Court. Registered land <br /> goes to Land Court, and recorded land goes to the Registry of Deeds, requiring the need for <br /> two different plans going to two locations. <br /> The highlighted portion in orange are the maintenance sheds, to be part of Mashpee <br /> Commons special permit. Lot 24 conveyed from 40B to the Special Permit, so land has to be <br /> traded. Of the three green parcels going from Mashpee Commons into the 40B, two are in <br /> recorded land, and one parcel is part of registry land. The last revision done after Land Court, <br /> requires a singular notation to combine Lots 24 and 26 after conveyance of title, at the bottom <br /> of the plan, as a requirement of Land Court. <br /> Ms. Waygan inquired about a blue line labeled D. It was noted that is a drainage line. Jobs <br /> Fishing Rd is taking water into a private retention and the easement that surrounds that pipe. <br /> Mr. Tobin noted this was originally approved in 2023, and Land Court then wanted utilities and <br /> easements and further details. The amount of time that required caused this plan to expire. <br /> This is before the Board again for a new vote. There was removal of names of private ways <br /> because they are not public roads. Lastly, Land Court commented it doesn't have to conform <br /> with zoning, as they have assured us this will be part of a land swap agreement already <br /> executed by entities. They will come back once it's done and these lots will merge. <br /> 9 <br />
