MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 14, 2026 <br /> The Board of Health comments dated January 12, 2026, were read into the record; "House to <br /> remain 3 bedrooms. Upgrade of system is needed for•raze and replace. Since sewer is connecting <br /> in the future variances may be applied for". <br /> Mr. Bonvie would like the engineers to include the drainage calculations and storm water <br /> management information depicted on the site plans going forward. <br /> Mr. Morris had no comments. The Board agreed that a curb cut permit would be required for the <br /> driveway on Captains Row. <br /> Mr. Bonvie asked for a motion to close the public hearing. Mr. Furbush so moved. Ms. Sangeleer <br /> second. All were in favor. <br /> Mr. Morizio made a motion that the Board issue a Special Permit for 367 Mashpee Neck Road <br /> with the following conditions: <br /> I. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2. Plot Plan — 367 Mashpee Neck Road, Date: September 24, 2025, Sheet 1 of 1, Date: <br /> 10/15/25: Add Captains Row Front Setback, and Southerly Side Yard Setback. 11/5/25: <br /> Add Landscape/Land-Use Are Delineations, 12/28/25: Relocate House out of Flood Zone, <br /> 1/9/26: Revise Future Sewer Connection Location. Prepared by: Cape & Islands <br /> Engineering, Stamped and signed on 1/9/26 by: Jacob Fricke No.: 59305 PLS, and Mark <br /> Dibb, No.: 45937 Professional Engineering. <br /> 3. Building Plans: Pro-Mod Homes, LLC, 367 Mashpee Neck Rd., EVI: Front Elevation, <br /> FP I: Ist Story Floor Plan, FP2: 2nd Story Floor Plan, Prepared by: ICON Legacy, Date: <br /> 10/1/25 Prelim, 12/23/25 Revised prelim. <br /> 4. Conditioned on all Town Department comments read into the record including but not <br /> limited to the Board of Health and Conservation Department comments. <br /> 5. A curb cut permit is required on Captains Row. <br /> 6. Any changes to the plans will require the applicant to return to this Board. <br /> 7. Conditioned that the applicant seek and obtain the Planning Department review in <br /> reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior to the application of a <br /> building permit. <br /> 8. The Board finds under §174-17.1 and §174-33 that the proposed project as submitted is not <br /> substantially more detrimental to the neighborhood than the existing conditions prior to <br /> removal of the existing structure, and that there is adequate land area on the subject lot to <br /> provide sufficient parking, and there are no new nonconformities being created. <br /> 9 <br />
