MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 14, 2026 <br /> The Board asked if a curb cut permit is required. Mr. Morris said no because the street is private <br /> and located in the Popponesset neighborhood. <br /> There were no more questions from the Board. There were no abutters present. <br /> Mr. Bonvie asked for a motion to close the public hearing. Mr. Reidy so moved. Mr. Furbush <br /> second. All were in favor. <br /> Mr. Reidy made a motion for the application. <br /> 27 Ocean Bluff Drive: Petitioner, Lionstone Construction requests a Written Finding under§174- <br /> 17 and §174-33 of the Zoning Bylaws to allow for a 250 sq. ft. addition within the 50 ft. buffer of <br /> the wetlands, and replacement of an existing in-ground pool on property located in the R-3 Zoning <br /> District, governed under the 1964 New Seabury Special Permit, Map 123, Parcel 207, Mashpee, <br /> MA. (Owner of Record: 27 Rainbow LLC). <br /> Sitting on this hearing are the four regular Board members and Associate Member, Mike Morizio. <br /> Mr. Andrew Arias represented the applicants requesting a Written Finding for a 250 sq. ft. addition <br /> on the carriage house. This property is located with the New Seabury Special permit. The <br /> application is relevant to Section 174-33 of the Zoning Bylaws for the 50-ft. setback to wetlands. <br /> The property is situated within the buffer zone on Shore Drive and on the ocean side. The project <br /> also includes replacing the existing odd-shaped pool and will be replaced with a rectangular pool. <br /> The project was approved by the Conservation Commission and conditioned with significant <br /> mitigation situated on both coastal banks. <br /> The Conservation Department comments dated January 9, 2026 were read into the record; <br /> "Resource Areas: Buffer zone to Coastal Bank and buffer zone to Coastal Dune. Amended Order <br /> of Conditions application was approved with a unanimous vote due to all work is within existing <br /> pool and building envelope and mitigation plantings are proposed on the coastal bank.Application <br /> was approved with the following condition of all pool drawdown must be removed with a pump <br /> truck. <br /> The Board of Health comments dated January 12, 2026, were read into the record: "On Private <br /> Sewer. Septic abandoned 2-2-12. " <br /> The Board reviewed the site plan and determined that the project addition and pool are within the <br /> New Seabury Special Permit. The size of the pool is being slightly reduced and will be setback <br /> further from the buffer zone. <br /> Mr. Morris had no issues with the project but required a finding from the Board under Section 174- <br /> 33 of the bylaws. <br /> There were no more questions from the Board. <br /> 11 <br />
