Town of Mashpee Conservation Commission <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> Discussion: (Public Comment solicited for each discussion - *3 minutes per comment) <br /> • Water Quality: Issues and initiatives (ongoing discussion item) <br /> • Current winter conditions for vista pruning time of year restrictions <br /> The Commission reviewed a draft policy that would allow, on a year-by-year basis, consideration of limited <br /> extensions to the March 1, 2026, vista pruning deadline in the event of severe winter conditions. Staff confirmed <br /> that a pre-work site inspection is required prior to any pruning activity to ensure compliance with approved limits <br /> and to verify that no active nests are present. If nests are observed,work may not proceed. Vista pruning approvals <br /> issued through a Notice of Intent run with the property in perpetuity; if work is not completed before March 1, <br /> 2026, it may be performed the following year without refiling, subject to staff inspection. Commissioners discussed <br /> whether to include a February 1 cutoff for newly issued Orders of Conditions. It was noted that applicants are <br /> responsible for filing in a timely manner and that the Commission would not meet again prior to March 1. The <br /> Commission expressed that the timing burden remains with the applicant. Staff also advised that vista pruning <br /> language currently appears in multiple regulations and recommended that the Bylaw Working Group (f/k/a Bylaw <br /> Review Subcommittee) consolidate all related provisions into a single regulation for clarity and ease of future <br /> updates. The Commission discussed adopting the policy and incorporating it into the existing vista pruning <br /> protocols, with further regulatory review to occur at a later date. <br /> MOTION: To accept the draft policy for Vista Pruning and include the February policy <br /> as a point that people can view regarding the pre-work site inspection. <br /> Discussion: Staff requested clarification regarding whether the proposed winter <br /> extension policy would apply to previously approved vista pruning permits, <br /> including two permits approved at the prior meeting. <br /> It was confirmed that the extension would apply to previously approved <br /> permits, as they were already authorized. The policy would apply to all <br /> eligible approvals from this point forward. <br /> Motion bv: Paul Colombo Seconded by: Sandi Godfrey <br /> Vote: Motion passed by unanimous vote. <br /> (Steve Cook, Paul Colombo, Sandi Godfrey, Seana Pitt, Richard Sahl) <br /> • Tennis Courts— 129 Daniels Island Rd (Lot#1386)—Brian Lewis to present <br /> Brian Lewis, on behalf of New Seabury Marina LLC, sought informal feedback regarding the former tennis courts <br /> at 129 Dennis Island Road. The courts, dating to at least the 1970s, are deteriorated and overgrown. The Marina is <br /> interested in purchasing the unbuildable lot and restoring the existing clay court footprint for tennis or pickleball <br /> use. If restoration is not feasible, the area may be used for kayak storage. No excavation, boat storage, or trailers <br /> are proposed; parking would remain at the marina. <br /> Commissioners raised concerns about coastal flood risk and potential kayak storage within Land Subject to <br /> Coastal Storm Flow, citing projected inundation data. Staff noted the courts likely predate wetland regulations <br /> and may qualify as grandfathered, recommending administrative approval limited to vegetation clearing and <br /> assessment within the existing footprint. Any reconstruction, fencing, or change of use would require a Request <br /> for Determination of Applicability or Notice of Intent. <br /> 2 <br />
