MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APEALS <br /> MARCH 25, 2026 <br /> NEW HEARINGS <br /> O Gunters Lane: Petitioner, Marc Drainville, with GHD, Inc. on behalf of Wastewater <br /> Management requests a Modification to the Special Permit (SP-87-05-053) under <br /> §174-31 of the Zoning Bylaws, registry Book 6259, Page 140. Proposal is for a <br /> subsurface wastewater treatment system and treated water leaching area; the total <br /> disturbed area is proposed to be less than seven (7) acres, within the cluster <br /> subdivision (Pimlico Heights Subdivision Plan Book 448, Pages 4-10) on property <br /> located in the R-5 Zoning District, Map 2, Parcel 170, Mashpee, MA "(Owner of <br /> Record: Town of Mashpee)" <br /> Sitting on this hearing were Ms. Sangeleer, Mr. Furbush, Mr. Goldstein, Mr. Bonvie, <br /> and Mr. Morizio. <br /> Attorney, Jonathan Eichman presented the modification application. Also present <br /> was Mr. Marc Drainville, PE, and Jared Meader, Wastewater Superintendent. At the <br /> last hearing dated February 11, 2026, there were objectives and questions raised <br /> by Attorney Henchy, and the abutters about the application and how the bylaws <br /> apply. At that hearing those questions were addressed to Attorney Eichman and Mr. <br /> Drainville to respond to those questions. Attorney Eichman reviewed the tape, <br /> extracted those questions and provide the Board a memorandum dated February <br /> 20, 2026, with his answers to those questions (confirmed receipt of the Board). <br /> Attorney Eichman stated that Mr. Drainville was asked to provide more detail <br /> regarding the plans of the project for a portion of the open space located in the <br /> cluster subdivision. Mr. Drainville is prepared to discuss the details of the testing <br /> that was performed, and the environmental permits that are required for this <br /> project. <br /> Mr. Bonvie mentioned that there was some discussion that this hearing could <br /> possibly be extended. Attorney Eichman stated that the Town did not request an <br /> extension and is willing to move forward. Mr. Bonvie concurred. <br /> Attorney Eichman listed and addressed five objections in his memorandum; <br /> Objection 1: refers to the Zoning Bylaws §174-24 C (9), modification prohibiting <br /> removal of the open space of the Pimlico Cluster Subdivision. He responded to the <br /> procedural steps that the bylaws set forward and criteria for consideration of the <br /> Town's vision that apply to the Board consideration of this application. This section <br /> provides for modifications of existing special permits. On page 2 of the <br /> memorandum refers to the clause that the Zoning Board of Appeals is the permit <br /> granting authority of special permits. No one is contesting that this special permit <br /> does not exist; the cluster subdivision exists. <br /> 2 <br />
