MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APEALS <br /> MARCH 25, 2026 <br /> He mentioned that there was a question raised about the type of modification; any <br /> proposed change to the site plan of the project. This is not what is being proposed <br /> for this project. There is not a 5% increase in use which the special permit granting <br /> authority believes may potentially impact abutting landowners, may be approved by <br /> vote of the special permit granting authority only after a public hearing following the <br /> requirements of subsections 2 through 7. Those subsections are above Section 8 and <br /> listed on pages 3 and 4 of its memos and refer to the criteria for modifications of a <br /> special permit. <br /> Attorney Eichman stated that this allows the Board to consider this application to <br /> potentially have an impact on abutters. This application refers to removal of the <br /> open space and contesting this does not have an impact on abutters. This <br /> application applies under the criteria of subsections 2 through 7. He referred to <br /> §174-24 C (9) (d) that applies to the site plan of the project. This project does not <br /> apply to the increase in land area; it will be decreasing the land area. This project <br /> is not increasing the land area that's occupied by a project, it will be decreasing the <br /> land area. He referred to the percentages calculated on Page 3 that will increase to <br /> 6%. <br /> Attorney Eichman referred to §174-24 (C) (9) (g) in his memorandum on Page 3. This <br /> application does not involve an increase in the number of units of dwellings. This <br /> Section does not apply to the application. This project is a request for reduction in <br /> the amount of open space in the cluster subdivision. The land that will be removed <br /> from the open space will be for the auxiliary sewer treatment facility. The application <br /> is simply to request that the Board approve the removal of the open space of this <br /> cluster subdivision. <br /> Mr. Bonvie asked the Board if they reviewed the memorandum and if they had any <br /> questions for the applicant. The Board accepted and reviewed the memorandum <br /> that was submitted by Attorney Eichman. Mr. Bonvie also reviewed over 200 pages <br /> of the engineering report submitted by Mr. Drainville and is willing to move forward. <br /> He was specifically impressed with the groundwater model and believes this is a <br /> well-designed project. In his opinion, the driveway is designed at a DOT level <br /> roadway system standard. <br /> 3 <br />
