One may exist from Jobs Fishing Rd. through the back <br /> side of the property within weeks of opening. Even a pedestrian pathway would be beneficial. <br /> Also, the First Citizens Federal Credit Union may benefit by allowing pedestrian access. He <br /> noted the Board also never heard from them. He applauds Trader Joes and the developer with <br /> all the changes and cooperating with the Board and all comments. <br /> Ms. Faulkner asked Mr. Kirrane if the master deed gives easement on Prescott Way. <br /> Mr. Kirrane believes Prescott Way is private. This resulted from a decision from this Board; the <br /> boat storage company was taken over by EJ Prescott and Waggs Rd. became Prescott Way. <br /> The fire gate was a modification to the special permit. A member of the Deer Crossing <br /> Association was there in favor because they didn't want a thoroughfare. These notices go to all <br /> abutters; we have multiple meetings with abutters to participate. If some other stake holders <br /> don't want to input, we can't go chase them around because we gave notice. It's not realistic. <br /> Jobs Fishing Road nor First Citizen's is going to allow a driveway. The topography wouldn't <br /> even allow it. We have already tried to make pedestrian connections from Jobs Fishing to this <br /> property, and we cannot control putting pathways over land they don't own. EJ Prescott is the <br /> owner of former Waggs Road. <br /> Ms. Faulkner asked what would allow access to Prescott Way, and it was noted an agreement. <br /> Mr. Kirrane stated back in the 80's there was a plan for a subdivision that never got built. That <br /> road may extend to the residents, he is unsure. She asked who owns that land where the road <br /> stops. Mr. Kirrane believes it's part of Deer Crossing Association; he has not done title work on <br /> Deer Crossing. <br /> Mr. Hansen stated from his aerial view of the land and property line, Waggs Rd. and Prescott <br /> Way do run into Shellback through the backside, a paper road or continuation through the gate <br /> and upper part of Deer Crossing commercial area. Access also goes to the upper shops. It <br /> seems logical to extend that road for additional Association access. Could the Town get an <br /> agreement with EJ Prescott? <br /> 7 <br />
