MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 8, 2026 <br /> There are four non-conformities. The first is the lot size at 5,597 sq. ft. The rear <br /> lot area is coastal bank and flood zone. The total lot area is 7,068 sq. ft. The rear <br /> of the house is 19 ft. from the coastal bank and is a non-conformity from the 50 <br /> ft. setback. There is a 7.7 ft. non-conformity on the north side yard setback and <br /> 9.9 ft. from the south side yard setback. There are no new non-conformities being <br /> created or intensifying any existing non-conformities. The existing lot coverage <br /> based on 5,597 sq. ft. is 22.67%, which is 1,269 sq. ft. of lot coverage. There will <br /> be a slight increase in lot coverage to 24.81%, which is 1,389 sq. ft. and is less <br /> than the 25% maximum allowed in the Popponesset Overlay District. The home <br /> will be building code compliant. The Conservation Commission approved the <br /> project, and a new IA septic system will be installed. The drainage calculations <br /> were provided to the Board. The project is consistent with other developments in <br /> the neighborhood. <br /> There is also sufficient parking for two vehicles. The driveway is 27 ft. wide and <br /> is over 30 ft. long. The required dimensions would be 9 ft. wide and 20 ft. long <br /> for one car, and 18 ft. by 20 ft. for two cars. This property exceeds the <br /> requirement. <br /> The Board can find that under Section 174-17.1 this project will not be <br /> substantially more detrimental than the existing non-conforming structure and <br /> use to the neighborhood, and that there is sufficient parking as required. <br /> Mr. Bonvie mentioned going forward he would like to see a plan submitted <br /> depicting the setbacks that show two vehicles on the plan like the 28 Wilsons <br /> Grove project. <br /> Attorney Kirrane said that the site plan depicts adequate parking for two <br /> vehicles. If the Board wants a drawing showing two vehicles, he can provide that. <br /> Mr. Furbush stated that he is fine with the plan submitted. <br /> Mr. Bonvie was satisfied with the drainage calculations. <br /> Mr. Furbush asked if the house is in a flood zone. Attorney Kirrane said no; the <br /> house is not in the flood zone and is not in the velocity zone. <br /> Mr. Morris is concerned with the block foundation. If there is an increase in the <br /> basement area it would be required to return to the Board. <br /> Mr. Sullivan said his structural engineer confirmed that the existing foundation <br /> will support a second story. He said he has no plans to renovate the basement. <br /> 7 <br />
