MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MAY 13, 2026 <br /> Mr. Dale is asking for a minor modification to the existing plan to extend a northerly patio corner, <br /> adding an additional 51 sq. ft. and also adding an 8 ft. by 14 ft. plunge pool within the same <br /> footprint of the existing patio. The lot coverage will increase from 18.4% to 18.7% and is still <br /> under the 20% requirement. This minor plan change was approved by Mass DEP, and a revised <br /> Superseding Order of Conditions reflecting these changes issued on December 12, 2025. <br /> Mr. Goldstein read the Conservation Department comments dated May 12,2026;"NOI application <br /> was approved by the Commission, and the applicant received a Superseding Order of Conditions <br /> from MassDEP. Proposed work on the parcel at this time is jurisdiction of MassDEP only unless <br /> a new NOI application is submitted for work outside the scope of the current work limit. " <br /> Mr. Reidy read the Board of Health comments dated May 11,2026,into the record; `No comment, <br /> septic is in front, no heavy equipment over septic system. <br /> Mr. Furbush wanted clarification of the patio location. Mr. Dale said that the patio exists and was <br /> approved; the additional patio addition is 51 sq. ft. in the northerly corner, and the pool will be <br /> situated within the patio footprint. <br /> Mr. Goldstein stated that the raised patio is not included in lot coverage. <br /> There were no comments from the audience, and no further questions from the Board. <br /> Mr. Bonvie asked for a motion to close the public hearing. Mr. Furbush so moved. Ms. Sangeleer <br /> second. All were in favor of closing the public hearing. <br /> Mr. Reidy moved to approve the Modification to the existing Special Permit (SP-2024-04). Mr. <br /> Goldstein second. All were in favor. <br /> 31 Nick Trail: Owner, 31 Nick Trail, LLC requests a Special Permit under §174-17.1 and §174- <br /> 33 of the Zoning Bylaws to raze a single-family dwelling and replace it with a new single-family <br /> dwelling on property located in the R-3 and the Popponesset Overlay District, Map 117, Parcel <br /> 271, Mashpee, MA. <br /> Mr. Reidy read Attorney Brian Wall's letter dated May 8, 2026, into the record requesting <br /> continuance until June 10, 2026. <br /> Mr. Bonvie asked for a motion to accept the continuance.
