(3-2 Doesn't Pass) <br /> Ms. Waygan noted this is out of ourjurisdiction. <br /> Mr. Milbury stated they let us down. The Commission slams mitigation down our throat with <br /> efforts that don't impact the immediate area. All in favor. <br /> After inquiry, Mr. Tobin explained the condition requires a title search regarding the prohibition <br /> of the curb cut on Route 28 on the past ANR for the lot and Counsel for the ANR reviewed this <br /> condition and did not raise any concerns. <br /> The Town Planner explained that Finding #34 is the standard objective criteria under our <br /> zoning bylaw, necessary for a special permit to be approved. It is included in every approval <br /> decision. He further explained that with Findings #34 & 35, a motion to deny the Special Permit <br /> would be based on the criteria of a project having adverse public health and safety, significant <br /> impacts to traffic flow or traffic safety, significant adverse impacts or otherwise detrimental to <br /> the Town/area. <br /> Both Ms. Faulkner and Mr. Milbury gave prepared statements as to why they were opposed to <br /> the proposed project, Trader Joe's. <br /> Ms. Faulkner referenced Trader Joe's business model. Trader Joe's is unlike any other <br /> specialty grocery store that she knows. Understanding Trader's business model is important in <br /> evaluating public safety and traffic implications as to the proposed Mashpee store. TJ's <br /> generates very high sales per square foot of store area and has high customer turnover which <br /> create the chaos we see in the parking lots and access points to Trader Joe's. This chaos is a <br /> PUBLIC SAFETY ISSUE. <br /> Ms. Faulkner described public safety risks. The traffic study UNDERESTIMATES the number <br /> of vehicles that will travel to Trader Joe's.
