She asked <br /> about Attachments H, I, J, and K. <br /> The applicant answered those were responses to the Cape Cod Commission's questions. Part <br /> of the Cape Cod Commission's process is they ask different questions about varying heights. <br /> Ms. Faulkner inquired about the balloon test performed in 2023, is the balloon seen more often <br /> when it is sunny or cloudy? <br /> Mr. Vellante answered if the balloon is in the clouds, you won't see it as well. A couple photos <br /> taken show fog. Every photo that was non visible was referenced to ensure the balloon was <br /> not seen. <br /> Ms. Faulkner showed one site it can be seen at Mashpee Commons, at one angle. As a <br /> homeowner, is she going to be looking at this? <br /> Mr. Vellante stated typically they drive on all roads in the area and through Mashpee <br /> Commons to identify places you could see it from. There are trees on sides of the road, but a <br /> clear-cut area would be visible to the pole. It may be blocked by vegetation. A test done in <br /> 2021 shows leaves were off in a colder month, and it shows no real material difference. The <br /> only difference is a higher height would stick out farther on top. <br /> Mr. Milbury stated aside from the road that enters into Cooks and the 99 Restaurant, there is <br /> not a lot of residential buildings in that area. <br /> Mr. Tobin asked the applicant if those 2021 photos were submitted to the Board with the pole <br /> height of 150ft.? <br /> Photos were shown from the Mashpee Rotary for a 150ft. pole, seeing it visible above the <br /> trees from that location. The 130ft. pole was not visible from that location. There is a decent <br /> amount of evergreens there. <br /> There is an As of Right Federal Law that grants the applicant 20ft. Meaning, they would be <br /> able to increase the height of the pole to 150ft. as of right. <br /> Mr. Tobin mentioned the Board and the applicant should have a detailed conversation <br /> regarding the relationship of need and pole height after peer review is able to comment. <br /> 6 <br />
