of TMs s,s
z.
Aannin Board
c
16 Great Neck Road NOYth
wlashpee, Aassachusetts 02649
Mr. Milbury asked about the ditch and Mr. Crispin answered the depression is the stormwater
system.
Mr. Tobin acknowledged this is more detailed than an ANR. He does appreciate the details
being shown, lot names, square footage, and drainage being labeled. All of that is property line
and easement information, with no engineering components on that plan.
Mr. Crispin stated the easement wasn't recorded. The only thing that is changing is adding land
to the back of lots that already exists on record. The special permit has no minimum frontage or
lot area.
Ms. Waygan commented that this is a definitive plan and is wondering why we are not
modifying.
Nick Galanis said the engineer laid out homes and BSC Group did the engineering plan, and
thus was not aware of the 20ft. buffer. One house is longer, that is the only reason they are
adding 20ft. on the back of lots. They are keeping the same plan. He referred to Board member
Milbury knowing every homeowner in that area has the same lot square footage. He takes
offense to being told he is trying to pull a fast one here. Plenty of New Seabury homes in
Sandalwood are governed by HOAs that have buffers.
It was noted this is across from the National Wildlife Refuge and conservation.
Mr. Galanis commented Sandalwood is not in the New Seabury special permit. The special
permit from 1964 is not governed. The only issue he has, if a future homeowner wants to
extend the patio, they are now restricted. He is looking out for future homeowners. That lot in
question he is planning a regular home closer to the front of the lot line so all homes stay in line.
Ms. Waygan is super uncomfortable with this as we just did a definitive subdivision plan, and
this should have come in as a modification.
Mr. Crispin explained there is no change to road drainage or grading, other than lot lines, it is
entitled to an ANR endorsement. It meets minimum frontage and lot area, in this case doesn't
exist. It's a parcel change and this goes to Land Court.
Ms. Waygan would like the opinion from Town Counsel. Say we vote to deny, then Counsel
says we were wrong to deny, then what.
Mr. Tobin noted, likewise, they could withdraw and agree to modify.
Ms. Waygan asked about their appeal options if they were to deny.
20
