MASHPEE ZONING BOARD OF APPEALS <br />Meeting Minutes <br />June 10, 2026 <br /> <br /> <br />Attorney Kirrane stated that the setbacks regulations of the Town are somewhat <br />different than what the State has regarding inland banks. He believes that this <br />inland bank is defined under the Town. <br /> <br />The Board asked for the measurements of what exists now and what will become <br />when the pool is installed. Attorney Kirrane stated that the house is already within <br />the wetlands, so the setback is zero and the same for the cranberry bog. <br /> <br />Attorney Kirrane stated that the setback is depicted on the site plan for the house <br />is at 24.8 ft. and will become 11.5 ft. The bog is a 250 ft. buffer reducing the setback <br />by approximately 13 ft. <br /> <br />Ms. Pamela Aggerbeck spoke to the Board and feels that she has done everything that the <br />Town has requested and more. <br /> <br />Mr. Bonvie asked for Board comments. Mr. Goldstein has no issues, Mr. Blaisdell has no <br />issues and that Conservation will be doing a lot of mitigation. Mr. Bonvie has no issues. Ms. <br />Sangeleer has no issues. Mr. Furbush was not sure. <br /> <br />Mr. Bonvie asked for a motion to close the public hearing. Mr. Reidy so moved. Mr. <br />Blaisdell second. All were in favor. <br /> <br />Mr. Reidy made a motion that the Board approve the Written Finding request with <br />the following conditions: <br /> <br />1. The Board has determined that the applicant meets the conditions of a Written <br />Finding under Mass General Law 40A Section 6. <br /> <br />2. Site Plan – 49 The Heights, Prepared by: Homestead Consulting Engineers, <br />Project No.: 900-067, Scale: 1” = 10’, Revisions: 12/30/25 Conservation <br />Comments, 1/14/26: Updated Mitigation, 2/9/26: Mitigation Plantings, <br />5/20/26: Lot Coverage Removed Per Counsel.
