MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 8, 2026 <br /> Attorney Wall suggested the following; the Board conditions approval that the <br /> applicant shall contact Conservation Department staff and shall request <br /> administrative approval to upgrade the two catch basins as suggested by <br /> Chairman Bonvie, and if permission is granted then the applicant shall install <br /> the upgraded catch basins with surface grates to capture surface water flow. But <br /> if administrative approval is not granted, then the applicant shall install the <br /> catch basins as depicted on the plan. Also, to amend the Zoning Data Table as <br /> suggested by the Board Chair. <br /> Mr. Morizio noticed that the side yard dimension was not depicted correctly on <br /> the site plan. <br /> Mr. Morris will require an elevation certificate stamped by an engineer confirming <br /> the height of the original grade, and before the permit is issued, he will require <br /> stamped approval for the existing foundation that will allow the extra load of the <br /> building. He's concerned that if there's a problem with the original foundation, <br /> and if the plans change, you will be required to return to this Board. He requires <br /> the engineering approval documents during the permitting process and building <br /> process, prior to the frame inspection for the building height. <br /> Mr. Bonvie questioned the building height depicted on the site plan as 29.9 ft. <br /> and this should be amended under the Zoning Table. <br /> There were no comments from the audience. There were no comments from the <br /> Board. <br /> Mr. Bonvie asked for a motion to close the public hearing. Mr. Blaisdell so moved. <br /> Ms. Sangeleer second. All were in favor. <br /> Mr. Reidy moved that the Board approve 31 Nick Trail with the following <br /> conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of <br /> a Special Permit under Mass General Law 40A Section 9. <br /> 2. Site Plan - 31 Nick Trail, Prepared for Brian Kelleher, Scale: 1" = 10', <br /> Existing and Proposed Conditions, Prepared by: Grady Consulting LLC, <br /> signed and stamped by: Tim Bennett, Professional Land Surveyor, No.: <br /> 36856 and Richard Grady, Civil Eng. No.: 38072. Date: 3/11/26, <br /> Revised: 4/15/26, 4/28/26, 5/11/26, and 6/3/26. A Landscape Plan <br /> dated 4/15/26 and Proposed septic system upgrade plan. Date 6/3/26. <br /> 4 <br />
