MASHPEE ZONING BOARD OF APPEALS MEETING MINUTES JULY 8, 2026 3. Conditioned that the Zoning Data Table on the site plan be amended in accordance with the discussion during the hearing relative to the requested modifications be submitted and reviewed by the Chair for approval. 4. Building Plans - Prepared for 31 Nick Trail, Date: 2/18/26. A-1: Foundation Plan, A-2: First Floor Plan, A-3: Second Floor Plan, Front Elevation, A-4: Elevations. Prepared by: Peter J. Karb, Registered Architect. 5. Conditioned on all Town Department comments read in the record including but not limited to the Board of Health, Conservation and Building Department comments, specifically conditioned upon an elevation certificate stamped by the engineer confirming the height of the original average grade, a stamped certificate approval that the existing foundation will allow the capacity load of the proposed building and confirming the building height prior to the frame inspection. 6. Conditioned that the applicant contacts the Conservation Department staff and requests administrative approval to upgrade the two catch basins as suggested by the Board, and if permission is granted then the applicant shall install the upgraded catch basins with surface grates to capture surface water flow. But if administrative approval is not granted, then the applicant shall install the catch basins as originally depicted on the plan. 7. Any changes to the plans will require the applicant to return to this Board. 8. Conditioned that the applicant seeks and obtains the Planning Department review in reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior to the application of a building permit. 9. The Board finds under §174-17.1 and §174-33 that the proposed project as submitted is not substantially more detrimental to the neighborhood than the existing conditions prior to removal of the existing structure, and that the plan depicts adequate land area on the subject lot to provide sufficient parking, and there are no new nonconformities being created.
