MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 8, 2026 <br /> 3. Conditioned that the Zoning Data Table on the site plan be amended in <br /> accordance with the discussion during the hearing relative to the <br /> requested modifications be submitted and reviewed by the Chair for <br /> approval. <br /> 4. Building Plans - Prepared for 31 Nick Trail, Date: 2/18/26. A-1: <br /> Foundation Plan, A-2: First Floor Plan, A-3: Second Floor Plan, Front <br /> Elevation, A-4: Elevations. Prepared by: Peter J. Karb, Registered <br /> Architect. <br /> 5. Conditioned on all Town Department comments read in the record <br /> including but not limited to the Board of Health, Conservation and <br /> Building Department comments, specifically conditioned upon an <br /> elevation certificate stamped by the engineer confirming the height of the <br /> original average grade, a stamped certificate approval that the existing <br /> foundation will allow the capacity load of the proposed building and <br /> confirming the building height prior to the frame inspection. <br /> 6. Conditioned that the applicant contacts the Conservation Department <br /> staff and requests administrative approval to upgrade the two catch basins <br /> as suggested by the Board, and if permission is granted then the applicant <br /> shall install the upgraded catch basins with surface grates to capture <br /> surface water flow. But if administrative approval is not granted, then the <br /> applicant shall install the catch basins as originally depicted on the plan. <br /> 7. Any changes to the plans will require the applicant to return to this Board. <br /> 8. Conditioned that the applicant seeks and obtains the Planning <br /> Department review in reference to the Tree Bylaw Chapter 175 of the Town <br /> Bylaws prior to the application of a building permit. <br /> 9. The Board finds under §174-17.1 and §174-33 that the proposed project <br /> as submitted is not substantially more detrimental to the neighborhood <br /> than the existing conditions prior to removal of the existing structure, and <br /> that the plan depicts adequate land area on the subject lot to provide <br /> sufficient parking, and there are no new nonconformities being created. <br /> Ms. Sangeleer second, yes <br /> Mr. Blaisdell, yes, <br /> Mr. Morizio, yes, <br /> Mr. Bonvie, yes, <br /> Mr. Reidy, yes. <br /> All were in favor to issue a Special Permit. <br /> 5 <br />
