MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 22, 2026 <br /> Attorney Kwesell wanted Mr. Dirk to confirm that he only considers the 400 <br /> permitted units in his traffic study. <br /> Mr. Dirk said that 400 units is a substantial amount of units to be built. No one <br /> would suggest that 400 units could be constructed anywhere on Rte. 151, Jobs <br /> Fish Road, or Rte. 28 without improvements being necessary. If a traffic study is <br /> not prepared, there's no professional including the peer review consultant that <br /> suggests that you could add 400 units of housing, and that there would not be <br /> any mitigation associated with a 40B or not a 40B. The traffic study was not <br /> provided to the Town, and he is being asked to account for that 400 units of <br /> housing, they would certainly account for mitigation to support 400 units of <br /> housing, if nothing else for safety. Once that is identified, they would then add <br /> the mitigation information to that traffic study. In the opposite direction, not <br /> including the mitigation, you're asking for the Comprehensive Permit applicants <br /> currently before the Board to mitigate 465 units of housing, and I don't think <br /> that's intended. <br /> Mr. Furbush believes that the 40B was approved for all housing for all of <br /> Mashpee Commons not just Jobs Fishing Road. <br /> Attorney Haverty will take a look at what's been constructed, what is going to be <br /> constructed, and what has been approved. <br /> Attorney Kwesell mentioned that the 180-day deadline is Tuesday, September <br /> 22, 2026. She has heard from Attorney Haverty that there is a lot of work to do, <br /> including information they require, etc. The Board will need an extension <br /> particularly because the meeting is Wednesday, September 23, 2026. She <br /> suggested that a written extension be submitted to the Board. <br /> Attorney Haverty mentioned that he certainly believes his team will not be ready <br /> by September 22, 2026. Generally, when he represents an applicant, he does not <br /> grant extensions until the last hearing before the deadline otherwise you end up <br /> granting extensions for periods of time well beyond what is necessary to complete <br /> the hearing. He will be prepared at the August 12, 2026, meeting to discuss an <br /> extension. <br /> Lynne asked the applicant what the Board should be prepared to discuss at the <br /> meeting on August 12, 2026, which the peer reviewers should have present at <br /> that meeting.
