Town of Mashpee Conservation Commission 16 Great Neck Road North Mashpee, MA 02649 documenting qualifying grandfathered docks could remain permissible. Staff recommended limiting repairs to an existing dock footprint, including storm-damage repairs, while prohibiting expansions. Members emphasized that the concept was intended as a temporary measure to allow the Commission time to review and update its dock regulations rather than create a permanent prohibition on new docks. Staff noted that some residents had expressed concern that the proposal would result in an indefinite ban and reiterated that this had never been the Commission's intent. Staff also provided an update regarding several storm-damaged docks observed during a recent site visit. Two property owners had received fines, and staff was awaiting a response from another property owner regarding whether the damaged dock would be removed or repaired. The Chair suggested that additional research be completed before the Commission's next quarterly meeting on November 5, 2026, including information regarding existing docks, waterfront properties potentially eligible for future docks, and environmentally sensitive water bodies. Updates: (*IS minutes) (Public Comment solicited for each update—3 minutes per comment) • Red Brook Road Culvert(Waquoit Bay Research Reserve—grant assistance) Staff provided an update on the proposed Red Brook Road Culvert replacement project. It was reported that the design is being revised after property ownership and easement issues were identified,primarily on the Falmouth side of the project. Once the revised plans are complete, the project will return to the Commission for permitting. Staff explained that the project will replace the deteriorated culvert at the Mashpee—Falmouth town line to improve stormwater management and restore fish passage. Coordination with the Town of Falmouth, the Association to Preserve Cape Cod (APCC), and other agencies is ongoing. It was noted that construction will be subject to seasonal environmental restrictions and will require temporary road closures and detours. Residents will be notified before construction begins. Staff reported that funding has been secured for the pennitting phase and that nearly all construction funding has also been obtained. The broader restoration effort includes upstream habitat improvements; however, property ownership issues, unauthorized dams, and the need for temporary construction easements continue to present challenges. The current focus is on completing the culvert replacement while evaluating the feasibility of the larger restoration project. Staff stated that the duration of any road closures cannot be detennined until permitting is complete and the construction schedule is finalized. Staff also noted that the project will return to the Commission for a public hearing as part of the permitting process, at which time residents will have an opportunity to provide comments. 7
