MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 12, 2026 <br /> 7. A Variance of 50' from the setback to wetland as set forth in 174-33 is <br /> approved as the whole lot is in the flood zone and no structure could be <br /> built without encroaching upon the 50' setback to wetland. <br /> 8. The applicant has demonstrated that strict enforcement of the ordnance <br /> or bylaw would result in a practical difficulty. Said practical difficulty is <br /> that 100% of the lot is located within the flood zone and the practical <br /> difficulty was not self-created. <br /> 9. The Board finds that the Variance would allow the construction of a single- <br /> family dwelling which supports the production of housing. <br /> 10. The Board finds that there is no detriment to public health, safety and <br /> welfare to the neighborhood. The proposal meets all other dimensional <br /> requirements, single-family is an allowed, as of right use in the R-3 Zoning <br /> District. <br /> 11. The Board finds that there is no other feasible alternative that would allow <br /> the applicant to construct a single-family dwelling on the lot in absence of <br /> Variance relief. <br /> Ms. Sangeleer, second, yes, <br /> Mr. Blaisdell, yes, <br /> Mr. Furbush, yes, <br /> Mr. Goldstein, yes, <br /> Mr. Bonvie, yes. <br /> All were in favor to issue Variance relief. <br /> OTHER BUSINESS <br /> ➢ Approve July 22, 2026, Meeting Minutes. <br /> Ms. Sangeleer made a motion to approve the July 22, 2026, meeting minutes. <br /> Mr. Reidy so moved. All were in favor. <br />
