MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 12, 2026 <br /> Attorney Haverty is prepared to give a 30-day extension for that time period to <br /> October 22, 2026. If this meeting goes past the September deadline and <br /> recognizes that this is still not close to completion, he will ask for another <br /> extension. The applicant will not insist that the Board end the process before he <br /> believes that equally all necessary information has been submitted for the Board <br /> to make any decisions. <br /> Mr. Morizio wanted to confirm that the applicant will be requesting to remove <br /> trees in order to perform the soil testing and did not want to hold up the process. <br /> Attorney Haverty informed the Board that they can allow the applicant to perform <br /> tree removal in a small area to perform the soil testing on the lot when ready, or <br /> they can allow testing to be done post permit at construction. The Board has <br /> jurisdiction under the 40B for all requests. <br /> Lynne Sweet said to address this question to Allen & Major whether the testing <br /> can be done now or later. The Board can request a plan depicting which trees <br /> they will be removing and provide this information to Allen 8v Major. <br /> Mr. Pavlik with Allen 8v Major reviewed the prior documents and unfortunately <br /> was on vacation last week and was not able to perform a thorough review. One <br /> of his concerns whether or not the applicant was considering making additional <br /> changes because they refer to the responses that many of these covenants would <br /> be addressed in the final plans, and it was not clear if that meant post permit or <br /> another round of revised plans. <br /> There were no significant site plan changes and noticed that the parking layout <br /> and the building dimensions remain the same. There was discussion regarding <br /> the concerns about the limited playground area, and removal of trash, etc. If the <br /> Board is comfortable with the site layout of the building dimensions, etc., any <br /> approval document would require a number of detailed conditions which is <br /> difficult to determine, and Mr. Pavlik would like to see additional details now <br /> prior to any approvals. He mentioned there are requests for additional <br /> information from others such as MEPA on the adjacent site that is currently <br /> under construction., and that information should be presented and should <br /> include any site distance and any buffering that might be required etc. <br /> 11 <br />
