MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 26, 2026 <br /> The existing house is partially in the flood zone, and the line runs through the <br /> existing house and does not meet the 50 ft. setback from the wetlands under <br /> Section 174-33. The lot coverage is nonconforming at 27.9% where 25% is <br /> required under the bylaw. The front, rear and side setbacks are conforming. <br /> The proposed addition will replace the existing deck and decrease the lot <br /> coverage from 27.9% to 25.7%, which is 105 sq. ft. reduction in structure <br /> coverage. The rear yard setback, although conforming at 19 ft. will improve to <br /> 25 ft. <br /> Mr. Reidy read the Board of Health comments dated August 24, 2026, into the <br /> record; "NO increase in flow, house to remain 3 bedrooms. No bedrooms in <br /> basement. <br /> Mr. Reidy read the Conservation Department comments dated August 26, 2026, <br /> into the record; "Resource Areas: Coastal Bank, buffer zone to Bordering <br /> Vegetated Wetland, and bufferzone to Deans Pond. NOI application was approved <br /> unanimously due to improvements to storm water recharge, pervious patio <br /> installation, and overall reduction in nitrogen loading with the following conditions. <br /> • Three (3) year mitigation monitoring contract with a certified professional <br /> • Privacy fence must have wildlife passage clearance at the bottom <br /> • Return for Amended Order of Conditions if any changes to project" <br /> Mr. Bonvie asked if the scope of the project was reduced at the Conservation <br /> Commission meeting. Attorney Kirrane said he believes it was and will submit a <br /> revised plan eliminating the front entry way if the Board agrees to approve the <br /> project. <br /> The Board confirmed that the deck is being reduced. <br /> Mr. Morris had no issues. There were no comments from the audience. <br /> Attorney Kirrane will also add the parking design on the revised site plan if the <br /> Board agrees to approve the project. <br /> Mr. Bonvie asked if the application was filed prior to the new regulations <br /> submitted by the State. Attorney Kirrane said this application was filed back in <br /> May. <br /> Mr. Bonvie asked Mr. Morris if this application was filed after the new rules as a <br /> Written Finding would this require Zoning. Mr. Morris said that it would require <br /> a finding for the setback to wetlands. <br /> 2 <br />
